Guarantees of Legality in the Administration of Taxes

Abstract:

Diplomová práce se zabývá postavením osob zúčastněných na správě daní, zejména jejich možnosti obrany proti případným nezákonným zásahům správce daně, efektivnímu využití jednotlivých záruk zákonnosti při správě daní. V práci je také zkoumáno posílení postavení daňových subjektů v souvislosti s přijetím nového právního předpisu, který správu daní upravuje – zákona č. 280/2009 Sb., daňový řád. Práce vychází ze stručného vymezení daňové správy a institutů daňového práva. Těžištěm práce je pak charakteristika a analýza jednotlivých záruk zákonnosti, které lze při správě daní využít, jejich komparace jednak se zárukami ve veřejné správě s přihlédnutím na specifičnost správy daní, ale také komparace se zahraniční právní úpravou. Závěrem je pak vyhodnocení a návrh autora na případné změny, které by bylo vhodné na úseku správy daní provést.

Abstract:

This dissertation deals with the position of persons involved in the administration of taxes, in particular the possibility of defence against the potential unlawful interference by the tax administration, the effective use of the individual guarantees of legality in the administration of taxes. The thesis also examines the empowerment of taxpayers in connection with the acceptance of new legislation which regulates the administration of taxes - Act No. 280/2009 Coll. Tax code. The work is based on the short definition of the tax administration and tax law institutes. The focus of thesis is mainly the characterization and analysis of the individual legality guarantees that can be used in tax administration, their comparison with either the guarantees in the public administration, considering the particularity of the tax administration, orthe comparison with the foreign legislation. In conclusion, there is the author evaluation and proposal of possible changes that would be appropriate in the area of tax administration make.
