Proceedings on offenses focusing on offences in the area of civil coexistence

Abstract:

Anotace: Tato bakalářská práce se věnuje problematice současného přestupkového práva a s tím související právní úpravou řízení o přestupcích. Cílem práce je analyzovat aktuální právní úpravu přestupkového řízení a následně tuto právní úpravu zhodnotit. Práce je rozdělena na část teoretickou a na část praktickou. Teoretická část nejprve nastíní historický vývoj přestupkového práva na našem území, poté představí novou právní úpravu a v komparaci poukáže na některé změny s předchozím zákonem o přestupcích. Bakalářská práce následně poukáže na slabší stránky nové právní úpravy a zároveň předloží návrhy a doporučení k nastíněným nedostatkům. Praktická část bakalářské práce vysvětlí pojem občanské soužití, seznámí s nejčastějšími druhy přestupků na úseku občanského soužití a uvede konkrétní příklad přestupku proti občanskému soužití. Závěr bakalářské práce na základě praxe a zkušeností stanoví předpokládaný budoucí vývoj současných právních úprav.

Abstract:

Annotation: This bachelor's thesis deals with the issue of current misdemeanor law and related legislation on misdemeanor proceedings. The aim of the work is to analyse the current legal regulation of misdemeanor proceedings and then evaluate this legal regulation. The work is divided into a theoretical part and a practical part. The theoretical part first outlines the historical development of misdemeanor law in our territory, then introduces the new legislation and in comparison points to some changes with the previous law on misdemeanors. The bachelor's thesis will then point out the weaknesses of the new legislation and at the same time present proposals and recommendations for the outlined shortcomings. The practical part of the bachelor's thesis explains the concept of civil cohabitation, introduces the most common types of offenses in the field of civil coexistence and gives a specific example of a misdemeanor against civil cohabitation. The conclusion of the bachelor's thesis, based on practice and experience, determines the expected future development of current legislation.
