Immediate Termination of Employment Contract from the Side of Employee

Abstract:

Tato bakalářská práce se věnuje okamžitému zrušení pracovního poměru ze strany zaměstnance. V práci je nejprve rozebrán vznik pracovního poměru z obecného hlediska a druhy pracovních poměrů, které mohou vznikem nastat. Další část práce se zabývá principy rozvázání pracovního poměru, včetně konkrétních úkonů, které mohou účastníci učinit a jakými způsoby je možné ukončit pracovní poměr. V této části je rovněž podrobně charakterizován institut okamžitého zrušení pracovního poměru ze strany zaměstnance, a jaké jsou deklarovány důvody pro okamžité zrušení pracovního poměru. Na to navazuje část, kde je popisován přímý postup zaměstnance při okamžitém zrušení pracovního poměru dle zákona č. 262/2006 Sb., zákoník práce, ve znění pozdějších předpisů (dále též „ZP“). V poslední části jsou vyhodnoceny aplikace institutu okamžitého zrušení pracovního poměru ze strany zaměstnance z důvodů deklarovaných v ZP, včetně rozboru související judikatury a dat, poskytnutých některými dozorujícími a kontrolními orgány státní správy.

Abstract:

The aim of the thesis is to analyze legislation of immediate termination of employment relationship and to judge using this institute in the state and private sector. The first part of the paper deals with the date of the commencement of the employment in general and also types of employment, which can occur within its commencement. The following part deals with the rules of the severance agreement, including specific acts, which could be performed by both sides and also shows the ways how to terminate employment. In this part the institute of immediate termination of employment is being characterized in detail from the point of view of an employee and as well as the reasons for the termination. It is followed by the part, where is described the direct approach of the employee in the process of immediate termination of employment according to the law no. 262/2006 Coll., the Labour Code, as subsequently amended (hereafter the "LC"). In the last part applications of the institute of the immediate termination of employment from the point of view of employee are being evaluated from reasons declared in Labour Code, including analysis of the specific judicatures and dates provided by supervising and controller institute of state administration.
