Contract for work under construction from the perspective of the contractor

Abstract:

Předmětem této diplomové práce je rozbor smlouvy ve stavebnictví z pohledu zhotovitele, ve které se snažím zohlednit a vzít v potaz někdy jeho nepříliš záviděníhodné postavení. Teoretická část nastiňuje historický vývoj smluvních vztahů a smlouvy o dílo, rozebírá podstatné náležitosti, které jsou ve smlouvě nezbytně nutné včetně dalších náležitostí smlouvy. Dále popisuje postavení zhotovitele, jaká jsou jeho práva a povinnosti včetně práv a povinností objednatele. V praktické části se zabývám přípravou a provedením smlouvy, jak by smlouva měla vypadat a co vše by měla obsahovat včetně přiložených příloh, přijetí objednávky či stavební připravenosti. V poslední kapitole shrnuji poznatky z praxe.

Abstract:

The subject of this thesis is the analysis of the contract in construction from the perspective of the contractor, in which I try to take into account and sometimes take into account iťs not very enviable position. The theoretical part outlines the historical development of contractual relations and contracts for work, analyzes the essentials that are essential in the contract, including other terms of the contract. It also describes the position of the contractor, its rights and obligations, including the rights and obligations of the customer. In the practical part I deal with the preparation and execution of the contract, what the contract should look like and what it should include, including the enclosed attachments acceptance of the order or construction readiness. In the last chapter I summarize findings from practice.
