Specific Features of Employment of Persons with Disabilities

Abstract:

Práce se zabývá problematikou zaměstnávání osob se zdravotním postižením, zejména jejich ochranou v pracovněprávních vztazích a v právních vztazích zaměstnanosti. Vymezení osob se zdravotním postižením je podáno s ohledem na novou koncepci invalidity, systematika výkladu o vlastních nástrojích podpory se potom zakládá na následujících principech: lidskoprávní aspekt zdůrazňují pasáže věnované obšírněji pojatému mezinárodnímu právu, dále také nástinu ústavních základů materie; zachování principu rovnosti je přiblíženo rozborem antidiskriminačních záruk; klíčovou část práce představují pojednání o ochraně zdravotně postižených na trhu práce a při výkonu závislé práce. Jako komplementární k pracovněprávním opatřením podporujícím zaměstnanost osob se zdravotním postižením jsou na závěr práce zmíněny i prostředky z rámce jiných právních odvětví.

Abstract:

The thesis deals with a problem of employment of disabled people, namely with their protection in labour law relations and in legal relations of employment. Presented definition of disabled persons reflects a new conception of invalidity. While introducing specific instruments of support of the disabled, the author focuses on following principles: the human rights dimension is reflected in parts concerned with international law and with constitutional foundations of the studied issue; principle of equality is dealt with within an analysis of antidiscrimination guarantees. The key part of the thesis then focuses on protection of disabled persons on the labour market and in the employment. In the end of the thesis, the author identifies also instruments that are present in other branches of law, and that can be perceived as a complement to the labour law provisions supporting employment of disabled persons.
