Legal regulation of residential lease

Abstract:

Tato bakalářská práce se zabývá právní úpravou nájmu bytu. Tato práce je rozdělena do šesti kapitol, které se dále dělí na podkapitoly. V jednotlivých částech se práce věnuje od historické úpravy nájmu bytu až po současnou úpravu, která je pak více rozebrána a s předešlou právní úpravou porovnána. První kapitola se věnuje popisu historického vývoje nájmu bytu, od období říše římské, přes období feudalismu, osvícenského absolutismu, protektorátu až po současnost. Druhá kapitola pojednává o základních pojmech nájmu bytu, jež jsou klíčové pro celkové pochopení problematiky nájmu bytu. Ve třetí kapitole jsou rozebrány způsoby vzniku nájmu bytu, úprava institutu dobré víry a zakázaných ujednání a v neposlední řadě je zde upraven institut podnájmu, který je akcesorickým vztahem ke vztahu nájemním. Kapitola čtvrtá upravuje nájemné a jiné platby s nájmem bytu spojené. Pátá kapitola se zabývá úpravou práv a povinností smluvních stran, o jejíchž rovnost se nový občanský zákoník pokusil. A na závěr v kapitole šesté jsou upraveny nejčastější způsoby skončení nájmu bytu.

Abstract:

This bachelor's thesis deals with the legal regulation of residential lease. This thesis is divided into six chapters, which are further divided into subchapters. In the individual parts, the thesis deals with the historical regulation of residential lease to the current regulation, which is then further analyzed and compared from the previous legislation. The first chapter describes the historical development of residential lease, from the period of the Roman Empire, through the period of feudalism, Enlightenment absolutism, the protectorate to the present. The second chapter deals with the basic concepts of residential lease, which are key to a general understanding of the issue of residential lease. The third chapter discusses the ways of residential lease, the regulation of the institute of good faith and prohibited arrangements, and last but not least, the institute of sublease, which is an accessory relationship to the rental relationship. Chapter four regulates rents and other payments related to residential lease. The fifth chapter deals with the regulation of the rights and obligations of the contracting parties, whose equality the Civil Code tried to. Finally, in the sixth chapter, the most common ways of ending residential lease are regulated.
