Adjustment of child care in the Czech legal order and practice

Abstract:

Diplomová práce je zaměřena na péči o dítě v právním řádu a praxi se zaměřením na střídavou péči. V teoretické části se zaměřím na rodinu a dítě na rodinné právní vztahy. Dále popíši manželství, zánik manželství, rozvod, ale také dále možnosti svěření dítěte do péče. Významnou kapitolou je pak role orgánu sociálně-právní ochrany dětí (OSPOD), který má svou nezastupitelnou funkci, popíši a vysvětlím, kdo je kolizní opatrovník, a také popíši právní úpravu. Praktická část byla realizována prostřednictvím kvalitativního výzkumu formou kazuistik a analýzy s komparací. Provedena byla analýzu vzorku sběru dat. Na základě analýzy 6 kazuistik byly zodpovězeny jednotlivé dílčí výzkumné otázky. Provedenou analýzou bylo zjištěno, že střídavá péče by měla být ideálně stanovena po dohodě rodičů a měla by být vždy v zájmu dětí. Rodiče by mezi sebou neměli mít konflikty a měli by umět společně komunikovat v zájmu jejich dětí.

Abstract:

This thesis is focused on child care in the legal system and practice with a focus on joint custody. In the theoretical part I will concentrate on the family and a child and legal family relationship. I will also describe marriage, dissolution of marriage, divorce, and the means of awarding custody of child. An important chapter is the role of the body of social and legal protection of children (OSPOD), which has its irreplaceable function, I will describe and explain who is a child guardian, and I will also describe the legislation. The practical part was realized through qualitative research in the form of case studies and analysis with comparison. An analysis of the data collection sample was performed. Based on the analysis of 6 case studies, individual partial research questions were answered. The analysis found that joint custody should ideally be awarded as a conclusion of parental agreement and should always be in the best interests of the children. Parents should not have conflicts with each other and should be able to communicate together for the sake of their children.
