Clausula Rebus Sic Stantibus in the Light of the pandemic

Abstract:

Diplomová práce se zabývá institutem podstatné změny okolností (klauzule rebus sic stantibus) a jeho využitím v rámci pandemie one-mocnění COVID-19 a jiných mimořádných událostí. Cílem práce je na-stínit momentální úpravu institutu v občanském zákoníku, popsat zá-kladní předpoklady jeho aplikace, jeho právní následky a roli soudu v souvislosti s podaným návrhem na obnovení rovnováhy práv a povin-ností, či zrušení závazku. Následně se autor snaží posoudit, jaké situace mohou být relevantním důvodem pro aplikaci tohoto institutu a zda mezi ně patří i pandemie, respektive mimořádná opatření s ní spojená.

Abstract:

The thesis deals with the legal institute of substantial change of cir-cumstances (rebus sic stantibus clause) and its use in the context of the COVID-19 pandemic and other extraordinary events. The aim of the thesis is to outline the current regulation of the institute in the Civil Co-de, to describe the basic prerequisites for its application, its legal con-sequences and the role of the court in regard with the submitted propo-sal for restoring the balance of rights and duties or annulment of the obligation. Subsequently, the author tries to assess what situations can be a relevant reason for the application of this institute and whether they include a pandemic or the extraordinary measures associated with it.
