Chosen Requirements and Nature of Decisions of the President of The Czech Republic

Abstract:

Diplomová práce se zabývá povahou rozhodnutí prezidenta republiky, kterými jsou uskutečňovány pravomoci prezidentu svěřené Ústavou České republiky. V této práci jsou tato rozhodnutí rozebírána nejen z pohledu rozhodnutí jako takových, ale též s ohledem na způsob, kterým je realizována volba prezidenta v České republice, včetně analýzy změny volebního systému, a dopad, který tato změna mohla mít na úřad prezidenta republiky a výkon jeho rozhodnutí. V rámci práce jsou analyzována vybraná rozhodnutí prezidenta republiky společně s případnými přezkumnými rozhodnutími, která v těchto věcech byla vydána. V závěru jsou zhodnocena analyzovaná rozhodnutí a na jejich základě je vytvořen návrh, který by do budoucna mohl zamezit některým jevům problematického chování, kterých se v moderních dějinách České republiky prezidenti opakovaně dopouštěli.

Abstract:

Master's thesis deals with the decisions of the president of the Czech republic. These decisions are powers which are granted to president of the Czech republic by the Constitution of Czech republic. In this master's thesis those decisions are thoroughly analysed not only with focus on decisions itself, but also with regard to the way in which president is established in Czech republic, because election system and its amendment from year 2013 introduced change in the election system from indirect to direct election system of the president. Due to the very specific way with which each president performed his duties in office. This thesis also includes brief description of each president of the independent Czech republic. Analysis of this amendment together with analysis of selected decisions of the president and selected judgments of Supreme Administrative Court and Czech Constitutional Court, altogether led to the conclusion which is described in the final part of the thesis which includes proposal on the amendment of the Constitution of Czech republic, which could prevent future problematic types of behaviour, imposed by the president.
