The determination of the ownership

Abstract:

Disertační práce se zabývá určením vlastnictví jako způsobu ochrany vlastnického práva. Jde o doplňující právní prostředek ochrany tohoto absolutního práva vedle tzv. vlastnických žalob, jejichž koncept byl vypracován již v římském právu. Určení vlastnictví se lze domáhat tam, kde právní postavení vlastníka je nejisté a do subjektivního práva nebylo ještě zasaženo. Tato nejistota má být odstraněna prostřednictvím soudní deklarace práva či právního vztahu. Určení vlastnictví má význam zejména ve vztahu k evidenci vlastnického práva v katastru nemovitostí. Uvedený způsob ochrany mohou užít též spoluvlastníci, dědici či manželé. Jedná se o obecný způsob ochrany vlastnictví, v případě, že se lze domáhat svého práva pomocí speciálních právních předpisů, nemá zde tento obecný právní nástroj místo.

Abstract:

The Dissertation is dealing with the determination of the ownership as a general way, how the ownership right can be protected. It is considered to be a legal institute in order to protect the ownership as an absolute right, which is complementary to so-called proprietary actions, which concept had been already developed in the Roman law. The determination of the ownership can be determinate merely there, where a legal status of an owner is uncertain and when a subjective right of the owner has not been interfered so far. The uncertainty can be eliminated through the declaration of existence of a subjective right or the declaration of an existence of the legal relationship. The determination of the ownership has a major significance in relation to the Land Registry and to a record of the ownership in the Land Registry. The above mentioned way of protection can be also used by a point-owner, legitimate heir and by spouse. It is a general way of protection the ownership; in a case when the right can be protected through more special legislation, the action for the determination of the ownership can not be used anymore.
