The influence of suggestive questions and the interviewer behavior on testimony of crimimal act witness

Abstract:

Cílem této práce bylo zjistit, jaký vliv na svědeckou výpověď mají kladené otázky, a též přístup, který tazatel ke svědkovi během výslechu zaujímá. A dále nalézt shody či rozpory mezi výpověďmi svědka podaných během prvního a opakovaného výslechu. Teoretická část práce přináší souhrn dosavadních poznatků souvisejících s výslechem svědka. Ve výzkumné části je prezentován výzkum, ve kterém jsme se snažili prokázat, že odměřený přístup tazatele, stejně tak jako uzavřené a sugestivní otázky, ovlivňuje svědeckou výpověď. Výzkumný soubor čítal 67 participantů, rozdělených do dvou experimentálních skupin, lišících se v přítomnosti přátelského či odměřeného chování tazatele. Participanti po zhlédnutí záznamu trestného činu podstoupili nejprve výslech ve formě rozhovoru a o týden později formou online formuláře. Prokázali jsme, že typ kladených otázek má vliv na správnost odpovědí svědka. Avšak zvolený přístup tazatele má vliv pouze na změnu výpovědi svědka během opakovaného výslechu. Obsah výslechového dialogu má tedy na přesnost výpovědi větší vliv než způsob dotazování svědka. Práce přináší poznatky z oblasti výslechové sugestibility, které mohou napomoci vyšetřovatelům trestných činů při vedení výslechu svědka.

Abstract:

The aim of this study was to find out if the questions and the behavior of the interviewer towards the witness during the interrogation, will influence witness testimony. And also find matches or discrepancies between witness testimony made during the first and repeated interrogation. The theoretical part of this thesis summarizes previous knowledge related to witness interrogation. The research section presents a study in which we tried to prove that interviewer's behavior as well as closed and suggestive questions, affects witness testimony. The sample included 67 participants divided into two experimental groups, based on whether the interviewer behaviror was friendly or abrupt. After seeing the crime record, the participants underwent an interrogation in the form of an interview and a week later they completed an online form. We proved that the type of questions asked affects the accuracy of the witness's answers. However, the behavior of the interviewer only affects the change in witness testimony during repeated interrogation. The content of the interrogation dialogue has much influence on the accuracy of the testimony than the manner in which the witness is interrogated. This study brings findings from the area of interrogation suggestibility, which can help criminal investigators with witness interrogation.
