Economic and Legal Aspects of the Existence of Municipalities with Emphasis on the Role and Concept of Land Ownership

Abstract:

Zvolené téma Ekonomické a právní aspekty existence obcí s důrazem na roli a koncepci pozemkového vlastnictví popisuje a analyzuje vybrané okruhy institutu pozemkového vlastnictví obcí, a to v jeho poměrně širokém pojetí vč. souvisejících otázek hospodářských a zvláště daňových, poukazuje na význam pozemkového vlastnictví obcí coby ekonomických zdrojů příjmových částí obecných rozpočtů a prostředku k plnění veřejných funkcí. Těžištěm práce je historicko-právní analýza institutu pozemkového vlastnictví obcí s komparativními prvky jak z daňové a rozpočtové oblasti, tak se slovenskou právní úpravou majetku obcí a nakládání s ním. Významnou součástí práce je i vzájemné porovnání jednotlivých institutů v různých časových obdobích ve smyslu dobových právních úprav odpovídajících danému politickému prostředí a nazírání na význam obcí, a také jejich transformace. Z pohledu časového se práce zabývá obdobím od roku 1862 v podstatě až do současnosti, mimo období existence národních výborů v letech 1950 – 1990 z důvodů v práci blíže rozvedených. Zvláštní pozornost je věnována právní úpravě ošetřující majetek obce, absenci efektivních kontrolních mechanismů při nakládání s obecním pozemkovým vlastnictvím a nutnosti vymezení určitého majetku obce jako nezcizitelného.

Abstract:

Selected theme Economic and Legal Aspects of the Existence of Municipalities with Emphasis on the Role and Concept of Land Ownership describes and analyses selected scopes of municipal land ownership in its wide interpretation, including economical and especially tax questions. It refers to relevance of municipal land ownership as a financial source of income parts of municipal budgets and the way to fulfil public functions. The core of theme is based on historical – legal analysis of municipal land ownership with comparative components both tax and budgetary sphere and Slovakian legislation of municipal land ownership and its management. Reciprocal comparison of particular land law institutes from various stretches of time is the significant part of this dissertation, because it includes a view corresponding with specific political times and its land law conception also. During the times this dissertation dealt with the era since 1862 to the present, with exception the period of national committees delimited by period from 1950 to 1990, the reasons are shortly mentioned. Exceptional attention is focused to the part of land law – municipality estate, missing control elements associated with management of municipal land ownership and to the necessity to define the specific part of municipal estate as inalienable.
