Proceedings for administrative infractions in the first instance

Abstract:

Diplomová práce se zabývá problematikou rozhodování o přestupcích v prvním stupni. V úvodu práce jsou definovány prameny přestupkového práva a základní zásady řízení. Další část definuje obecné pojmy přestupkového řízení, jeho účastníky a další osoby zúčastněné na přestupkovém řízení. Dále jsou rozebrány postupy před zahájením řízení o přestupku a doručování písemností. Následuje část, která se věnuje samotnému řízení o přestupku, včetně provádění dokazování a rozboru situací, za nichž lze řízení přerušit nebo dokonce zastavit. Určitý prostor je věnován i zvláštním druhům řízení, konkrétně se jedná o společné řízení, řízení o náhradě škody a o vydání bezdůvodného obohacení a vydání příkazu, včetně příkazu na místě. Jednou zahájené řízení je nutno i ukončit, a proto je i poměrná část práce věnována problematice vydávání meritorního rozhodnutí. Poslední část práce se věnuje právní moci a vykonatelnosti rozhodnutí, včetně mezinárodního vymáhání a úvahám de lege ferenda, zdali by bylo možné faktický výkon rozhodnutí nějak zlepšit.

Abstract:

The diploma thesis deals with the issue of decision-making on trespass in the first instance. The introduction defines the sources of the trespass law and the basic principles of trespass proceedings. The next part defines general terms of the trespass proceedings, its participants and other persons involved in the trespass proceedings. Furthermore, the procedures before the commencement of trespass proceedings and service of documents are discussed. This is followed by the section dealing with the trespass proceedings itself, including the taking of evidence and the analysis of situations in which proceedings may be interrupted or even closed down. A certain amount of space is also devoted to special types of proceedings, namely joint proceedings, damages proceedings and the issue of unjust enrichment and the issue of an order, including an on-the-spot order. The launched proceedings is also necessary to terminate, and therefore the proportional part of the thesis is devoted to the issue of decisions in the core of the matter. The last part of the thesis deals with the legal power and enforceability of decisions, including international enforcement and considerations de lege ferenda, whether it could be possible to improve the effective enforcement of the decision.
