Quality Guarantee as a Legal and Contractual Tool of Consumers Protection in Commercial Relations

Abstract:

The aim of this work is to issue guarantees on quality, which is a violation of the parties at odds. In each chapter we will discuss the characteristics guarantee quality, breakdown of law and contractual arrangements, division defects. We describe a time to notice defects in the goods for which the buyer may assert their claims arising from breach of contract based on the seller's liability for defects in the goods. We will consider buyer protection laws as well as procedures for reclamation of goods. In the end lists recommendations for modification of the contract, the application of which would be able to prevent possible disputes between the parties.

Abstract:

Cieľom tejto práce je priblížiť problematiku záruky za akosť, ktorej porušením sa zmluvné strany dostávajú do sporu. V jednotlivých kapitolách sa budeme zaoberať charakteristikou záruky za akosť, členeniu na základe zákonnej a zmluvnej úpravy, rozdeleniu vád. Popíšeme si doby na oznámenie vady tovaru, počas ktorých si kupujúci môže uplatniť svoje nároky vznikajúce pri porušení zmluvy na základe zodpovednosti predávajúceho za vady tovaru. Priblížime si ochranu kupujúceho podľa právnych úprav a tiež postup pri reklamácii tovaru. V závere uvedieme odporúčania na úpravu zmluvy, ktorých uplatnením by bolo možné predísť možným sporom medzi zmluvnými stranami.
