Institute of Hunting Guard and its Relation to the State Forest Administration in the Czech Republic

Abstract:

Předkládaná práce se věnuje problematice institutu myslivecké stráže. V práci je zejména řešeno současné postavení myslivecké stráže v legislativě České republiky a historický vývoj této legislativy a postavení myslivecké stráže. Současně je zde řešena problematika myslivecké stráže na Slovensku a porovnání těchto institutů v obou zemích. Zmínit například lze, že zatímco na Slovensku je veřejná stráž považována za speciální část policie a v legislativě jsou uvedeny i možné donucovací prostředky, v České republice se na veřejnou stráž nahlíží mnohem opatrněji a donucovací prostředky, které může stráž použít nejsou v zákoně přímo vyjmenovány. Samotná činnost myslivecké stráže je pak velmi podobná v obou zemích. Na Slovensku však chybí právní úprava odpovědnosti za škodu způsobenou mysliveckou stráží. Práce dále vyhodnocuje v praktické části výsledky šetření o přestupcích na úseku myslivosti zjištěných mysliveckou stráží a dotazníky vyplněné mysliveckou stráží.

Abstract:

The presented work deals with the issue of the institute of hunting guards. The work mainly deals with the current position of the hunting guard in the legislation of the Czech Republic and the historical development of this legislation and the position of the hunting guard. At the same time, the issue of hunting guards in Slovakia and a comparison of these institutes in both countries is addressed. For example, while in Slovakia the public guard is considered a special part of the police and the legislation also lists possible means of coercion, in the Czech Republic the public guard is viewed much more carefully and the coercive means that the guard can use are not directly listed in the law. The activity of the hunting guard itself is then very similar in both countries. In Slovakia, however, there is no legal regulation of liability for damage caused by hunting guards. The work further evaluates in the practical part the results of the survey on offenses in the field of hunting detected by the hunting guard and questionnaires filled in by the hunting guard.
