The Bill of Exchange and its Use in Trade-legal Relationship

Abstract:

Práce shrnuje základní poznatky o úloze směnek v obchodně právních vztazích. Uvádí přehled základních pojmů na základě směnečného zákona, následovaný výkladem o základních druzích a podobách směnek, jejich náležitostech a obecných principech jejich fungování. Jsou uvedeny vzory směnek obvykle užívaných v obchodní praxi. Po rozboru vybraných směnečných náležitostí, se práce v další fázi blíže zaobírá dvojím pohledem na směnku jako na platební nástroj, v kontrastu s tím také jako na prostředek zajištění a následně také shrnuje pozitiva a negativa směnky. Tato práce se zjevně snaží představit směnku v jejích nejrůznějších podobách a rozšířit tak povědomí široké veřejnosti.

Abstract:

The work summarizes basic knowledge of the role of bills of exchange in business and legal relationships. It defines basic terms based on the Bills of Exchange Act followed by commentary on the basic types and forms of bills, their terms and general principles of their functioning. It includes samples of bills usually used in the business practice. Following the analysis of selected terms, the thesis further deals with the dual view of the exchange bill as a payment instrument and, in contrast, as a form of security. This thesis also lists the positive and negative aspects of the bill exchange. The work obviously tries presenting the exchange bill in its various forms and expanding the public consciousness of it.
