The Questionability of Copyright Protection in Musical Industry

Abstract:

Tato práce se zabývá problematikou ochrany autorských práv v oblasti hudebního průmyslu. Jedná se o aktuální tématiku, která se dotýká každodenního života jedinců zapojených do společenského života. Práce je zaměřena zejména na charakteristiku legislativy v této oblasti a také na charakteristiku možných způsobů porušování práv spojených s tvůrčí duševní činnosti na poli hudebního průmyslu. Analyzuje činnost a spolupráci ochranných organizací, které mají tuto problematiku na starosti. Sleduje jejich snahu o vytvoření komplexního mezinárodního právního rámce, jež je pro dokonalé využití potenciálu duševního vlastnictví nezbytně nutný. Cílem práce bylo zhodnocení efektivity činností těchto organizací, jejich preventivních opatření zaměřených zejména proti tzv. internetovému pirátství a nalezení potenciálních způsobů řešení problémů v oblasti ochrany autorských práv na poli hudebního průmyslu. Výsledek této práce napovídá, že existence a aktivity ochranných organizací jsou pro hudební průmysl nezbytně nutné, nicméně jejich činnost by mohla být prováděna efektivněji. Existuje řada cest, jak dostatečně uspokojit právní nároky autorů a zároveň docílit spokojenosti těch, kteří hudební průmysl živí, tedy posluchačů.

Abstract:

This thesis takes an interest in the problem of copyright protection in music industry. It is an actual matter which covers an everyday life of each individual leading social life. The thesis is focused especially on the characteristics of legislation in this area and also on the characteristics of possible ways in violating rights connected with creative mental activities at the branch of music industry. It analyzes activities and co-operation of particular protective organizations that are in charge of this matter. It keeps an eye on their effort of creating a complex international legal framework which is absolutely necessary for complete utilization of the intellectual property potential. The aim of this thesis is to evaluate how effective the activities of these organizations are, to evaluate their preventative measures focused especially on so called internet piracy, and to find all potential ways of solving problems with copyright protection in music industry. The outcome of this thesis shows that the existence and activities of protective organizations are necessary for music industry nevertheless they might be conducted in a more effective way. There are several ways how to fulfil the legal interest of the authors adequately, and to reach full satisfaction of those who keep the whole music industry alive - the listeners- at the same time.
