The Comparison Lease of Non-residential Premises and Lease of Premises Used for Business with a Little Excursion to the French Law

Abstract:

Má diplomová práce se zaměřuje na komparaci nájmu nebytových prostor v předchozí právní úpravě a prostor sloužících k podnikání v současné právní úpravě s malou ex-kurzí do úpravy komerčního nájmu ve francouzské právní úpravě. Práce se snaží kom-plexně pojmout institut nájmu již od počátku jeho vzniku, dále obsáhnout jeho vývoj v rozsahu historickém a zejména vznik nájmu prostor sloužících k podnikání jako zvláštní podtyp nájmu. Rozebírá specifika daných institutů v závislosti na vývoji práv-ního prostředí, jejich zásadní rozdíly, změny s ohledem na praktičnost, ale také poziti-va a negativa jejich právní úpravy. Z toho důvodu jsem také pro svou práci zvolila me-todu analýzy jednotlivých charakteristik institutu nájmu v souladu s metodou kompa-rační, aby byly lépe viditelné rozdíly v jednotlivých právních úpravách.

Abstract:

My diploma thesis focuses on a comparison lease of non-residential premises in previ-ous legislation and lease of premises used for business in current legislation with a little excursion into a commercial lease arrangements in the French legislation. The thesis seeks comprehensively accommodate institute of the lease since the beginning of its establishment, to comprehend the extent of its development and in particular the historical lease commencement of premises used for business as a particular subtype of the lease. The thesis analyzes the specificities of those institutions depending on developments in the legal environment, their fundamental differences, changes with regard to practicality, but also the positives and negatives of their legislation. For this reason, I have chosen the method of analysis of individual characteristics of the lease institute in accordance with the method comparation to emphasize differences in the legislation.
