The constitutional complaint as a means of protection of fundamental human rights

Abstract:

Tato práce pojednává o institutu ústavní stížnosti jakožto základním instrumentu ochrany základních lidských práv. Ve svých úvodních částech přináší historický vývoj lidských práv, jejich terminologii a klasifikaci. Dále práce představuje ústavní soudnictví a Ústavní soud. Stěžejní část práce je věnována analýze ústavní stížnosti, především ústavní stížnost fyzických a právnických osob. Jsou v ní rozebrány veškeré náležitosti podání, náležitosti řízení o ústavní stížnosti a rozhodnutí. Závěr je věnován závaznosti a důsledkům rozhodnutí Ústavního soudu.

Abstract:

This thesis aims to describe the the institute constitutional complaint as an essential instrument of protection of fundamental human rights. In its introductory part brings the historical progression of humans rights, their terminology and classification. The thesis also introduces the concept of constitutional judiciary and the Constitutional Court. The crucial part of this thesis handle the analysis of the constitutional complaint, especially constitutional complaint of natural persons and corporate personhoods. In this section are analyzed all requirements for making a constitutional complaint, all requirements of judicial proceedings on constitutional complaints and the decision. In conclusion are discussed effectuality and results of decisions of Constitutional Court.
