Abstract:

Daň z přidané hodnoty se stala fenoménem moderní doby. Jedná se o nejvýnosnější daň v mnoha zemích, kde byla zavedena. Zejména v Evropě je daň z přidané hodnoty nepostradatelná z hlediska podpory volného pohybu zboží a služeb, ale také jako jeden z významných zdrojů příjmů rozpočtu Evropské unie. Dnes je to však již zcela jiná daň, než která byla v České republice přijata v roce 1993. Značné množství rozdílů mezi zeměmi a výjimek ze základních principů vede v Evropě k růstu mezery mezi teoretickým a skutečným výnosem této daně v posledních deseti letech. K tomu přispívají i rozrůstající se podvody. Reakcí na ně jsou četné změny právních předpisů na evropské i národní úrovni, což dále snižuje neutralitu daně a posiluje distorze. Výzkumným cílem disertační práce je na základě mezinárodní komparace navrhnout takové úpravy na úrovni EU a ČR, které by tento stav pomohly řešit. Existují dvě radikální cesty, buď návrat k základním principům daně odstraněním řady výjimek, nebo přechod na zcela jiný princip této daně prostřednictvím zavedení přenesené daňové povinnosti na veškerá plnění. Řešením je také přechod na příjmový typ DPH.

Abstract:

Value added tax has become a phenomenon of modern times. It is the most profitable tax in many countries where it was introduced. Value added tax is indispensable especially in Europe for promoting the free movement of goods and services. VAT also serves as one of the major revenues for the EU budget. Today, it is however a completely different tax than that one which was accepted in the Czech Republic in 1993. A considerable number of differences among the countries and exceptions from the fundamental principles lead to the growing gap between the theoretical and actual VAT revenues in the past decade in Europe. The growing frauds are also affecting this difference. As response to it there have been numerous legislative changes at European and national level which further reduce the tax neutrality and strengthen the distortions. The research target of this dissertation thesis is based on international comparisons which would suggest such regulations and changes leading to the solution of the situation at EU level as well as Czech Republic. There are two radical ways how to resolve the current unacceptable situation. Either to return to the basic principles of VAT by removing a number of exceptions, or switch over to an entirely different principle of this tax through total introduction of the reverse charge. The solution is also moving to the income-type VAT.
