Administrative Offences in Jurisdiction of the Customs Administration of the Czech Republic

Abstract:

Bakalářská práce je zaměřena na zjišťování a projednávání celních a správních deliktů prováděných Celní správou České republiky v rámci jejích kompetencí. Jednotlivé kapitoly teoretické části jsou věnovány vysvětlení základních pojmů, historickému vývoji celnictví, legislativě celních a správních deliktů. Dále popisuje organizační strukturu Celní správy České republiky a základní zásady správního trestání. V praktické části je řešen postup celní správy při řízení o celních a správních deliktech, od zajištění zboží, zahájení správního řízení, nařízení ústního jednání až po vydání rozhodnutí, včetně řádných opravných prostředků. Další část je věnována analýze a popisu nejzávažnějších forem páchání správních deliktů, které jsou doplněny tabulkami a grafy.

Abstract:

Bachelor's thesis is focused on identifying and dealing with customs and administrative offenses carried the Customs Administration of the Czech Republic within its powers. Individual chapters are devoted to the theoretical explanation of basic concepts, historical development of customs and costums legislation and management delictual. Also describes the organizational structure of the Customs Administration of the Czech Republic and the fundamental principles of management delictual punishment. Focus of the practical part is the procedure for customs authorities in the management of the customs and administrative offenses, the provision of goods, the initiation of administrative proceedings, the regulation of an oral hearing after the decision, including the proper means of correcting remedy. Another section is devoted to analysis and description of committing the most serious forms of administrative offenses, which are complemented by tables and graphs.
