Duties of the Travel Agencies by Organizing the Package Tours in the European Law

Abstract:

Diplomová práce je zaměřena na povinnosti cestovních kanceláří při organizaci zájezdu, potažmo na práva jejich klientů definovaná evropskou legislativou. Práce objasňuje vybrané pojmy, analyzuje problematiku organizování zájezdů z hlediska evropského i českého národního práva. Stejně tak práce popisuje situace, ke kterým může při organizaci a realizaci zájezdu dojít a které vyvstaly a jeví se jako problematické, stávajícími legislativními předpisy neupravené. První část diplomové práce je věnována organizaci a prodeji zájezdu v legislativě Evropské unie, konkrétně pak směrnici Rady č. 90/314/EHS ze dne 13. června 1990 o souborných službách pro cesty, pobyty a zájezdy a to včetně analýzy vybraných rozsudků Soudního dvora Evropské unie. Další část diplomové práce je zaměřena na implementaci směrnice do českého právního řádu zákonem č. 159/1999 Sb., o některých podmínkách podnikání v oblasti cestovního ruchu, konkrétně pak na proces tvorby tohoto zákona, jeho dopady na trh cestovního ruchu, vývoj situace od vstupu zákona v účinnost a aktuální problémy, které v souvislosti s vývojem situace na trhu vznikly. Třetí kapitola diplomové práce se pak zabývá procesem revize směrnice, který byl iniciován Evropskou komisí v roce 2007, doposud však nebyl ukončen. Práce také poukazuje na změny, které mohou být v rámci revize a novelizace směrnice nastoleny a které budou následně promítnuty i do českého národního práva.

Abstract:

The thesis is focused on the duties of the travel agencies when organizing the package tours or more precisely on the rights of their clients as defined by the European legislation. The thesis clarifies some terms, analyses the matters of organizing the package tours in terms of the European as well as Czech national law. The thesis also describes the situations which may arise within organization and realization of the tour and which might appear as problematic, not regulated by the current legislative. The introduction of the thesis is devoted to the organization and purchase of the package tours in the EU legislative, specifically the Council Directive 90/314/EEC of 13 June 1990 on package travel, package holidays and package tours including the analysis of some decisions of The Court of Justice of the European Union. Next part of the thesis is oriented on the implementation of the Directive into the Czech law by the Act No. 159/1999 Coll. On Certain Conditions of Business Activities in the Field of Tourism, especially on the process of creation of this act, its impact on the tourism market, the development and actual problems which have been occurring in the market since the Act come into force. The third part of the thesis is devoted to the revision process of the Directive which was initiated by the European Commission in 2007 and which hasn´t been finished till now. The thesis points out the changes which might be proposed within revision and novelization of the Directive and which will be subsequently implemented into the Czech legal system.
