Family of Liechtenstein between Confiscation and Expropriation. A Contribution to the Postwar Interventions to the Land Property in Czechoslovakia in the First Half of the Twentieth Century

Abstract:

Otázky spojené s vlastnictvím a vlastnickým právem už tradičně poutají zvýšenou pozornost filozofů, politiků a právníků. Zvláště názory a práce meziválečné civilistiky, která kriticky navazovala na rakouskou právní vědu 19. století, mohou být dnes inspirativní. Soudobé četné návraty k prvorepublikovému dědictví jsou současně reakcí na politický a právní vývoj po roce 1948 a dále jsou umocněny i faktem, že připravovaný občanský zákoník vědomě navazuje na zkušenost první republiky. Alespoň ve výběru jsem se také pokusil na pozadí zásahů do vlastnictví jako konfiskace, vyvlastnění a pozemková reforma představit názory na vlastnictví (resp. jeho garance a omezení), se kterými se můžeme v první polovině 20. století setkat. Jde o představy a myšlenky napříč společností od politiků a jiných osobností veřejného života až k řadovým občanům. Zvýšená pozornost je věnována přirozeně oblasti právní, kde nás zajímají názory doktrinální (F. Weyr a J. Sedláček) a judiciální (Nejvyšší soud a Nejvyšší správní soud). Současně se jasně ukazuje, jak obtížně se dnešní soudy s problematickým dědictvím minulosti - v principu již prvorepublikovým - vyrovnávají. Už v Ústavní listině z roku 1920 (§ 109) se s ohledem na meziválečnou pozemkovou reformu narušil tradiční princip ochrany vlastnictví a připravil se prostor i zákonné nástroje pro další zásahy do soukromého (zejména pozemkového) vlastnictví jako poválené konfiskace či znárodňování. Obecné aspekty zásahů do vlastnictví v první polovině 20. století v Československu jsou přiblíženy na pozadí osudů lichtenštejnských majetků reprezentujících charakteristické i výjimečné momenty těchto poválečných opatření.

Abstract:

The problems of property and property law have been enjoing traditionally intensive attention of filosofs, politics and jurists. Particularly inspirative for us can be the ideas and works of civil law specialists from the period between the two world wars which linked up critically with the century of Austrian legal science. The contemporary numerous returns to the heritage of the „first republic“ are simultaneously the reaction to the political and legal development after 1948, intensified by the fact that the prepared new Civil Code links up consciously with the experience of the “first republic”. In his article the author endeavours to present at least selectively the ideas on property, its guarantees and limitations existing in Czechoslovakia between the two world’s wars. They represent a spectrum across the whole society – from politicians and other public personalities to rankand-file citizens. Particular attention, naturally, is afforded to the field of law represented by doctrinal ideas particulary of Professors F. Weyr and J. Sedláček and judicial ideas of the Supreme Court and the Supreme Administrative Court. The problems of interference with property rights, particularly the confiscation after 1945, continue to return before the courts in various forms and their jurisprudence reveals how difficult it is to cope with the problematic heritage of the past – practically of the “first republic”. Already the 1920 Constitution Sec. 109, with reference to the land reform performed in the period between the two wars, broke the traditional principle of property protection and so prepared the conditions for confiscations, and nationalization. The general aspects of interferences with the property rights in Czechoslovakia in the first half of the twentieth century have been shown on the background of Liechtenstein-estates, which represent typical and characteristic, as well as exceptional moments of the alluded postwar actions.
