Dne 1.1.2008 nabyl účinnosti zákon č. 182/2006 Sb. o úpadku a způsobech jeho řešení (insolvenční zákon), který nahradil dřívější zákon č. 328/1991 Sb., o konkursu a vyrovnání. Tímto zákonem se otevřela cesta k zajištění větší transparentnosti a předvídatelnosti úpadkového řízení, posílení postavení věřitelů, motivace dlužníka ke snaze řešit svůj úpadek včas, možnost sanace dlužníka tam, kde je to vhodné …more
Abstract:
On 1 January 2008, Act No. 182/2006 Coll. on insolvency and methods of its resolution (Insolvency Act), which replaced the former Act No. 328/1991 Coll., on Bankruptcy and Settlement. This law opens the way for greater transparency and predictability of insolvency proceedings, empowerment of creditors, motivation of the debtor to try to solve his bankruptcy in a timely manner, possibility of debtor …more
