Stalking in context of domestic violence

Abstract:

Stalking je relativně moderním fenoménem. Problém je diskutován z hlediska kriminologie, forenzní psychologie a kriminálního práva. Nicméně, tento problém je znám od 18. století, kdy psychiatr Pinel popsal a objasnil fenomén erotomanie. Erotomanii můžeme definovat jako patologický attachement k nějaké druhé osobě. Ve druhé polovině 20. století de Clérambault popsal tří fázový model tohoto chování. Toto období je počátkem výzkumu oblasti stalkingu. Zájmu o výzkum takového chování předcházela vražda mladé herečky Rebbeccy Scheaffer z roku 1990 v San Franciscu. Stalking byl definován jako průběh chování směřovaný proti určité osobě a který by byl schopný vyvolat v racionální osobě důvodnou obavu. Stalking je charakterizován opakovaným a nechtěným chováním, které implicitně či explicitně ohrožuje oběť. Oběti takové chování pociťují jako nechtěné a nebezpečné jednání, které snižuje kvalitu jejich života. Stalking existuje na několika úrovních. Oběti mohou, ale nemusí si být vědomy toho, co se děje. Podobně útočníci mohou, ale nemusí mít zákeřný záměr. Opakem k jiným zločinům, které spočívají v jednotlivých aktech, stalking se sestává ze série aktů, které samy o sobě mohou být neškodné a legální. Stalking je více ovlivněn osobností útočníka, než situací. Vyskytuje se na všech socioekonomických úrovních, napříč každé společnosti. Dopad stalkingu na oběti je často velmi vážný. V této práci se zabývám propojením stalkingu s oblastí domácího násilí. Použil jsem zde kvalitativního typu výzkumu a rozhovorů s oběťmi domácího násilí a stalkingu.

Abstract:

Stalking is considered as a relatively modern phenomenon. This problem is discissed from standpoint of the kriminology, the forensic psychology and the criminal law. However, this problem has been known since the eighteenth century, when a psychiatrist Pinel described and clarified phenomenon of erotomania. We can define erotomania as a pathological attachement to some other person. In the second half of the twentieth century, de Clérambault described three-phase model of this behaviour. This period is the beginning of research in area of the stalking. The murder of Rebecca Scheafer, who was young acteress, in 1990 i San Fransisco, preceded the increasing of the interest in this problem. The stalking was defined as a course of conduct directed at a specific person that would cause a reasonable person fear. The stalking is further characterized by repeated and unwanted behaviour that implicitly or explicitly threatens the victims. The victims feel this behaviour as unpleasent and dangerous acts that decline their life´s duality. The stalking exists on several levels. Victims may or may not be avare that it is happening. Similarly, perpetrators may or may not have a malicious intent. Contrary to crimes that consist of a single act, the stalking consists of series of actions which in themselves can be legal. The stalking is influenced more by personality of perpetrators then by situation. The stalking occurs in all socioecomonic levels, throught out every society. The impact of the stalking on victims is capital. In this work I deal with the connection of the stalking with the area of the domestic violence. I used the qualitative research and interviews with victims of the domestic violence and stalking.
