The Right of the Child to Know His or Her Origins in the Case Law of the European Court of Human Rights

Abstract:

Cílem diplomové práce je vymezení práva dítěte znát svůj původ a rozsahu jeho ochrany v kontextu vybraných témat řešených v judikatuře Evropského soudu pro lidská práva. Nejprve budou vymezeny klíčové pojmy osobnost a s ní související osobnostní práva, dítě, otcovství a mateřství. Následně bude proveden rozbor mezinárodních a evropských lidskoprávních dokumentů, ve kterých je právo dítěte znát svůj původ přímo či nepřímo zakotveno. V této souvislosti bude věnována pozornost relativní povaze daného základního práva, pakliže se dostává do kolize s veřejnými zájmy či základními právy jiných osob, tedy matky a otce dítěte. Především se bude jednat o právo na soukromý a rodinný život. Za tímto účelem bude analyzována judikatura Evropské-ho soudu pro lidská práva v otázkách určování či popírání rodičovství a utajovaných porodů, včetně zohlednění zjištěných poznatků ve vztahu k problematice anonymity dárcovství pohlavních buněk, ke které se příslušný soudní orgán bude muset v blízké budoucnosti rovněž vyjadřovat.

Abstract:

The aim of the thesis is to define the right of the child to know his or her origin and the scope of its protection in the context of selected topics addressed in the case law of the European Court of Human Rights. First, the key concepts of personhood and related personality rights, child, paternity and maternity will be defined. Subsequently, an analysis will be made of international and European human rights documents in which the right of the child to know his or her origins is directly or indirectly enshrined. In this context, attention will be paid to the relative nature of this fundamental right, if it comes into conflict with public interests or fundamental rights of other persons, namely the mother and father of the child. In particular, the right to private and family life. To this end, the case-law of the European Court of Human Rights on the issues of determining or denying parenthood and clandestine births will be analysed, including taking into account the findings in relation to the issue of the anonymity of sex cell donation, on which the competent judicial authority will also have to comment in the near future.
