Empirical methods of interrogation

Abstract:

Tato diplomová práce je zaměřena na problematiku výslechu jakožto kriminalistickou metodu. V úvodu teoretické části se zabývá historickými počátky výslechu, základními pojmy, konstrukcí výslechu, komunikačním procesem a druhy výslechu. Dále práce rozebírá přípravu výslechu a jeho taktiku, tj. formování kontaktu vyslýchajícího s vyslýchaným, analýzu výpovědi, psychologickou pomoc vyslýchajícího vyslýchanému při výslechu a psychologické působení na vyslýchaného k překonání jeho orientace vypovídat lživě. V poslední kapitole se předložená práce zabývá dokumentací výslechu. Věnuje se zásadám dokumentace výslechu, kde pojednává o protokolu a jeho sepisování a v neposlední řadě jsou uvedeny i další možnosti dokumentace výslechu, jimiž jsou zejména kriminalistická fotodokumentace, kriminalistická topografická dokumentace a další druhy dokumentace, například videodokumentace. Praktická část práce se pak zabývá empirickým šetřením v rámci vězeňského prostředí a statistickým vyhodnocením dotazníků.

Abstract:

This diploma thesis is focused on issue of an interrogation as a criminalistics method. The introduction of the theoretical part deals with the historical beginnings of the interrogation, the basic concepts, the construction of the interrogation, the communication process and the types of interrogation. Furthermore, the work analyses the preparation of the interrogation and its tactics, i.e. the formation of contact of the interrogator with interrogated, the analysis of the testimony, the psychological assistance of the interrogator to interrogated person during interrogation and the psychological effect on the interrogated to overcome his / her orientation to testify falsely. The last chapter deals with the documentation of interrogation. It deals with the principles of interrogation documentation, where it analyses the protocol and its drafting. Last but not least, there are also indicated other possibilities of interrogation documentation, such as criminalistics photo documentation, criminalistics topographic documentation and other types of documentation, such as video documentation. The practical part of the thesis deals with empirical investigation within the prison environment and statistical evaluation of questionnaires.
