Contract for Work, Performance, Delivery, Acceptance

Abstract:

Tato práce se snaží podat srozumitelnou interpretaci právní úpravy týkající se smlouvy o dílo. Práce však není jen pouhým komentářem zákonných ustanovení,ale obsahuje názory, stanoviska a doporučení použitelné pro praxi uzavírání smluv o dílo zaměřených především na stavby. Je rozdělena do sedmi kapitol, které pojednávají obecně o smlouvě o dílo, jejím vývoji a její současné právní úpravě. V dalších kapitolách jsou rozebrány podstatné části smlouvy, provádění díla a splnění, odevzdání a převzetí díla. Závěr je věnován úpravě smlouvy o dílo v Německu a dále se věnuje shrnutí dílčích návrhů, poznatků a doporučení de lege ferenda.

Abstract:

This bachelor's work “contract for work, performance, delivery, acceptance "of trying to make intelligible interpretation of current legislation relating to contracts for work. At the same time through these ideas, observations and recommendations should be targeted for the practice of reaching agreement on work-oriented construction. The work is divided into 7 chapters, the first and the second chapter is rather an introduction to the problem. The first chapter describes the focus of work, requirements for processing and identification of targets, which would work should be achieved. The second chapter defines a contract for work, discusses its development, modification and relationship to other contract types. The third chapter deals with the essential requirements of contracts, which are important for its validity. There is a defined direct and indirect object of a contract for work and construction work as the subject. Furthermore, this chapter discusses the price for the work, how determined, how it can be determined in the contract, when and how the price paid for the work. In the conclusion chapter summarizes the observations and recommendations to the parties. The fourth chapter, we discuss the implementation of the work. The chapter is focused on things that are designed to perform the work, deals with the place and time of performance. It includes a mention of building construction, construction book and the possibilities of carrying out inspection work. Conclusion chapter includes recommendations and proposals de lege ferenda again. The fifth chapter focuses on the performance, delivery and acceptance of work. There are defined responsibilities of the contractor perform the work properly and correctly completed. To demonstrate the proper fulfillment of the obligations of the contractor may be arranged tests on which this chapter is also mentioned. It also deals with obligations and conditions of handover, the record of handover and transition of ownership. In the sixth chapter we find comparisons Czech adjustment contract for work with contract for work in Germany. The seventh and final chapter contains a summary of all knowledge.
