Abstract:

Bakalářská práce využívá deskriptivní výzkum založený na třech výzkumných otázkách k nalezení nejběžnějších forem porušení zákona agenturního zaměstnání. Porovnávám výroční zprávu SUIP 2018. Práce se zabývá zpracováním základních pojmů, jako je agenturní zaměstnávání, subjekty agenturního zaměstnávání, pracovněprávními vztahy. Cílem této práce je zjistit nejběžnější formy porušování zákona v agenturním zaměstnávání a navrhnout návrhy opatření v případě nedostatečnosti. Práce se skládá z teoretické a aplikační části. Teoretická část je věnována problematice. V aplikační části na základě výzkumu bylo zjištěno, Dále bylo zjištěno, že nejčastější forma porušování agenturního zaměstnávání je v častém nedostatečném vyplnění smluvních vztahů. Těmto nedostatkům lze zabránit tím, že poskytneme návrhy opatření v podobě dodatku do právní úpravy. V závěru ještě byla zkoumána novelizace a její dopad, přičemž se zjistilo, že novelizace právní úpravy je nedostatečná. Z celkového pohledu vyplývá, že oblast agenturního zaměstnávání bude muset být do budoucna více řešena a proběhne další právní úprava.

Abstract:

The bachelor thesis uses descriptive research based on three research questions to find the most common forms of agency employment law violations. I compare the annual report SUIP 2018. The work deals with the processing of basic concepts such as agency employment, agency employment entities, labor law relations. The aim of this work is to find out the most common forms of violation of the law in agency employment and to propose measures in case of insufficiency. The work consists of theoretical and application part. The theoretical part is devoted to the issue. In the application part on the basis of the research it was found out, It was also found that the most common form of violation of agency employment is in frequent insufficient filling of contractual relations. These shortcomings can be avoided by providing draft measures in the form of an amendment to the legislation. In the end, the amendment and its impact were examined and it was found that the amendment of the legislation is insufficient. Overall, it follows that the field of agency employment will have to be further addressed in the future and further legislation will take place.
