Protection of the Weaker Party in Family Law

Abstract:

Na prahu 21. století se ochrana slabší strany stává klíčovou zásadou soukromého práva, tedy i práva rodinného. Tradičně je za slabší stranu v oblasti rodinného práva považováno nezletilé dítě. V diplomové práci jsou rozebrány různé životní situace, ve kterých se člověk může ocitnout právě v pozici slabší strany, jejichž cílem je dokázat, že do postavení slabší strany se může dostat každý, a to s ohledem na okolnosti konkrétního případu. V práci je věnován prostor také srovnání s evropskými standardy a judikaturou Evropského soudu pro lidská práva a také úvahám de lege ferenda.

Abstract:

At the beginning of the 21century, the principle of protecting the weaker party is becoming the key principle of the Private Law, thus of the Family Law as well. Traditionally, the weaker party in the context of the Family Law is a minor child. In this thesis, various life situations are analyzed in which person might find himself in the position of the weaker party. These situations aim to prove that basically everybody might find himself in this position, with respect to the specific circumstances of each case. The thesis also focuses on comparing the European standards and judiciary of the European Court of Human Rights while also taking into consideratiin de lege ferenda.
