Institutions of Direct Democracy In The Political Systems of Central Europe Countries

Abstract:

Předkládaná diplomová práce pojednává o institutech přímé demokracie v zemích střední Evropy. Zkoumanými státy jsou Česká republika, Slovenská republika, Rakouská republika a Spolková republika Německo. Státy jsou vybírány na základě určitých společných faktorů, jako je geografická blízkost, velice podobná kultura, všechny čtyři země jsou členskými státy EU a všechny jsou zastupitelskými demokraciemi. Práce se zaměřuje na zmapování institutů přímé demokracie, kterými jednotlivé země disponují, a na to, jak je skutečně využívají. Dále na komparaci situace v jednotlivých státech kvůli zjištění, zdali má komunistická minulost nějaký vliv na využívání zmíněných institutů. Práce je strukturována do několika kapitol, v první části jsou představena teoretická východiska, je zde definována přímá demokracie, její kritika, a definovány samotné instituty, těmi jsou referendum, petice, lidová iniciativa a odvolání. Další kapitoly se pak věnují jednotlivým státům. U každého z nich je popsáno jaké instituty zakotvuje právní řád dané země, jak jsou jednotlivé instituty využívány, případně v jaké míře a o jakých otázkách v nich občané hlasují. V poslední, závěrečné části jsou shrnuty dosažené výsledky. Na základě informací, které jsou v práci popsány, bylo docíleno několika závěrů. V první řadě bylo zjištěno, že všechny čtyři země si jsou velmi podobné ve způsobu využití institutů přímé demokracie, které jejich právní řády zakotvují, zejména pak na nižší úrovni. Stejně tak si jsou podobné typy otázek, které jsou ve všech zemích řešeny na úrovni místní, krajské, případně spolkové republiky. Díky těmto zjištěním je možné tvrdit, že komunistická minulost České a Slovenské republiky neměla vliv na užívání institutů přímé demokracie, které jsou v obou zemích užívány podobným způsobem a s podobnou čestností jako v zemích bez komunistické minulosti.

Abstract:

The hereby presented thesis is about institutes of direct democracy in the Central European countries. The researched countries are: (i) the Czech Republic, (ii) the Slovak Republic, (iii) the Republic of Austria and (iv) the Federal Republic of Germany. The respective countries were chosen based on certain common features such as geographical proximity, cultural similarity, membership in the EU and the fact that all of them are representative democracies. The thesis focuses on identification and description of the institutes of direct democracy existing in each of the countries as well on the actual reality as regards its utilization. Furthermore the thesis focuses on comparison of the situation in each of the countries with respect to survey whether the communist history had any impact on the utilization of the researched institutes. The thesis is structured to several chapters. The first one introduces theoretical backgrounds including definition of direct democracy and its criticism and also definitions of the key institutes referendum, petition, people's initiative and appeal. Following chapters of the thesis deal with the individual countries, in each case describing the particular institutes implemented in the given jurisdiction, the way the institutes are actually utilized and eventually also the subjects of past elections and the extent of the citizens' participation. The last chapter contains summary of accomplished findings. Based on the information encompassed in the thesis the following conclusions have been made. First of all, it has been discovered that all four countries are mutually very similar as regards the utilization of the direct democracy institutes which exist in their legislation and especially so on the lower level. Similar are as well the types of issues (matters) which were dealt with (employing the institutes) in all of the countries at both local and municipal and eventually also federal level. Thanks to these findings it may be stated that the communist history of the Czech Republic and the Slovak Republic had not impact on the utilization of the institutes of direct democracy since these institutes are used in both of the countries in similar manner and with similar frequency as in states with no communism in its history.
