(Non)compliance of Spain's asylum policy with the asylum system of the European Union

Abstract:

Tato bakalářská práce se věnuje problematice souladu azylového systému Španělska s politikou azylu Evropské unie, která je reprezentována Společným evropským azylovým systémem. Cílem práce je prostřednictvím modelu „čtyř světů compliance“ klasifikovat vzorce chování Španělska vůči implementační povinnosti evropských právních úprav v oblasti azylu. Tato implementace do španělské vnitrostátní struktury je zkoumána ve fázi transpozice a při praktické implementaci. Práce analyzuje transpozici s přihlédnutím k obsahovému a časovému aspektu, praktická implementace je poté zkoumána skrz nastavené monitorovací a vynucovací mechanismy společně s aplikací daných norem v běžné praxi. Práce se zabývá jak evropskými směrnicemi, tak nařízeními, přičemž je věnována zvýšená pozornost rozdílům v aplikaci těchto dvou typů evropského práva ve španělském azylovém systému.

Abstract:

This bachelor thesis focuses on the topic of compliance of the asylum system in Spain with the asylum policy of the European Union, which is represented by the Common European Asylum System. The main goal of this thesis is to classify the behaviour patterns of Spain in connection with its implementation duties of the European asylum legislation using the “Four Worlds of Compliance” model. The implementation to the Spanish national structures is examined during the transposition phase and during the phase of practical implementation. The thesis analyses the transposition taking into account the content and time aspects. Practical implementation is studied through the monitoring and enforcing mechanisms, together with application of the norms in question in common practice. The thesis deals with both European directives and regulations, paying increased attention to the differences in application of these two types of European law in the Spanish asylum system.
