Surrogacy in the Czech Republic

Abstract:

Diplomová práce se zabývá procesem náhradního mateřství v ČR. V teoretické části jsou vymezeny pojmy, které se vztahují k náhradnímu mateřství. Zaměřují se na zprostředkování kontaktu náhradní matky a biologického páru, jelikož tím celý proces začíná, dále se věnuji dohodě o náhradním mateřství, která je i přes svou nevymahatelnost součástí téměř každého procesu a upravuje podmínky a práva mezi náhradní matkou a biologických párem a mimo jiné je v ní definována také finanční kompenzace. Věnuji se také kojení, jelikož biologické matky mají možnost kojit i bez porodu, jedná se ovšem o náročnou cestu a definován je také bonding, který má pozitivní vliv jak na dítě, tak i na biologickou matku. Dále je představena homosexualita, jelikož náhradní mateřství může být pro homosexuální páry cestou k vlastnímu dítěti. Závěr teoretické části je věnován tématu neplodnosti, jelikož neplodnost je nejčastějším motivem k vyhledání procesu náhradního mateřství. Pozornost je věnována také reprodukční klinice, kde celý proces začíná. Výzkumná část je zpracována formou narativního rozhovoru. Rozhovor je založen na osobní zkušenosti participantů s problematikou. Rozhovory byly realizovány jak s náhradními, tak i s biologickými matkami.

Abstract:

Master's thesis deals with the surrogacy process in the Czech Republic. In the theoretical part, terms related to surrogacy are defined. I focus on mediating the contact between the surrogate mother and the biological mother and the biological couple, as this is where the whole process begings, I also deal with the agreement on surrogacy, which, despite its unenforceablility, is part of almost every process and regulates the conditions and rights between the surrogate mother and the biological couple and, among other things, is it also defined financial compensation. Next part I dedicated to breastfeeding, as biological mothers have the opportunity to breastfeed even without giving birth, but this is a difficult journey and bonding is salso defined, which has a positive effect on both the child and the mother. Homosexuality i also introduced, as surrogacy can be a way for homosexual couples to have their own child. The conclusion of the thereotical part is devoted to the topic of infertility, sinde inferrtility is the most commnon motive for seeking the process of surrogacy. Attention i also paid to the reproductive clinic, where the whole process begins. The research part is processed in the form of a narrative interview. The intervier is based on the personal experience of the participants with the issue. Interviews were conducted with both surrogate and biological mothers.
