Abstract:

Tato bakala?r?ska? pra?ce r?es?i? problematiku otroctvi? ve stare?m R?i?me?. Ci?lem bylo vymezit a analyzovat instituci otroctvi? v kontextu r?i?mske?ho pra?va. Zvla?s?tni? pozornost je ve?nova?na za?niku otroctvi? u jednotlivcu?. Zde se pra?ce zaby?va? zejme?na syste?mem manumisi?, tedy propous?te?ni? otroku?, a jejich formami. V ra?mci teoreticke?ho usazeni? te?matu do kontextu historie je druha? kapitola ve?nova?na kaz?dodenni?mu z?ivotu otroka ve stare?m R?i?me?. Prakticka? c?a?st na?sledne? tvor?i? obra?zek instituce otroctvi? v ra?mci r?i?mske?ho pra?va. Samotna? analy?za probe?hla na za?klade? pra?ce s origina?lni?mi staror?i?msky?mi pra?vni?mi prameny a odborny?mi teoreticky?mi pr?i?ruc?kami o r?i?mske?m pra?vu a se zdroji mapuji?ci?mi pr?i?kladove? situace, ktere? c?asto vedly k dnes?ni? interpretaci r?i?mske?ho pra?va. Tyto texty, ktere? take? vne?ktery?ch pr?i?padech disponovaly origina?lni?mi latinsky?mi pr?edlohami pr?i?be?hu?, mohly ve?st ke vzniku ne?ktery?ch druhu? zmi?ne?ny?ch manumisi?. U te?chto textu? nebylo c?erpa?no pr?i?mo z latinske?ho origina?lu, ny?brz? z jeho anglicke?ho pr?ekladu. Vy?sledkem pra?ce je rozbor instituce otroctvi? v jeho celku, s du?razem kladeny?m na problematiku jeho za?niku.

Abstract:

This bachelor thesis covers the issue of slavery in ancient Rome. The goal is to define and analyze the institution of slavery in the context of roman law. Particular attention is given to the demise of slavery for individuals. The thesis covers the system of manumissions, enfranchisement of slaves, and its forms. The second chapter theoretically grasps slavery in its historical context of that time. The practical part creates a picture of slavery within roman law. The analysis itself is conducted based on operating with original legal sources form ancient Rome and with handbooks focused on roman law. These texts contained original latin depiction of stories of situations that could have led to the origins of the respective manumissions. The original latin texts are not the actual source of information, the english translation is. Result of the thesis is an analysis of the institute of slavery as a whole while stressing the issue of its demise.
