Origin, Evolution and Comparison of Legal Aspects of Marriage and Registered Partnership in the Czech Republic

Abstract:

Předmětem této diplomové práce je zachycení vzniku, charakteristika jednotlivých etap vývoje a samotná komparace právních aspektů manželství a registrovaného partnerství v České republice. Z důvodu provedené komparace se také věnuje problematice alternativních forem soužití ve vybraných evropských státech a v České republice. Práce vymezuje základní pojmy – rodina, manželství, od nichž odlišuje nesezdané soužití a především registrované partnerství, jako nový fenomén moderní doby. Soužití ženy a muže, mimo manželství, je v mnoha právních normách, z oblasti jak soukromého, tak i veřejného práva, reflektována s určitými právními následky. Práce obsahuje určité zmapování aktuálního právního stavu a hodnocení jednotlivých právních úprav. Vymezuje jednotlivé modely alternativních forem soužití, uplatňované v zahraničí a zároveň předkládá pohled na jejich právní úpravy s akcentem na skutečnost, zda se tyto úpravy týkají pouze osob stejného pohlaví nebo i osob odlišného pohlaví. Mezilidské vztahy, obzvláště vztahy mezi partnery, se v současnosti zařadily mezi velmi diskutovaná témata ve společnosti. Neustále se hovoří o stále se zvyšujícím počtu rodičů, vychovávajících děti ve vztazích mimo manželství, o krizi tradiční formy rodiny. Alternativní formy soužití jsou v současné době téma, bezesporu společensky velmi aktuální, proto také přijetí právní úpravy registrovaného soužití osob téhož pohlaví, při svém přijetí, vyvolalo značnou diskusi. Otázkou však zůstává, zda se Česká republika připojí k zemím, v nichž je umožněno uzavření manželství také osobám stejného pohlaví (např. Belgie, Španělsko, Nizozemsko), zda, a popřípadě kdy, dojde ke zrovnoprávnění institutu manželství a registrovaného partnerství v českém právním řádu? Přínosem této práce by mohl být podnět k zamyšlení de lege ferenda o nových možnostech a cestách, které by se mohly stát inspirací zákonodárců při eventuálních změnách českého právního řádu v oblasti partnerského soužití. Rodina je po staletí považována za stabilizující prvek společnosti, za cosi konstantního a téměř posvátného. Zároveň také jako, jediné tradiční a přijatelné, soužití muže a ženy. Nyní je však postavena před těžkou zkoušku. Předloženou práci lze také stručně charakterizovat jako pokus o nový, zcela nezaujatý, pohled na jednotlivé alternativní formy soužití mezi lidmi.

Abstract:

The subject of this dissertation consists in description of the establishment, of the main features of different development stages, as well as of the comparison of legal aspects of marriage and registered partnership in the Czech Republic. On the background of the comparison this dissertation also deals with the topic of alternative forms of cohabitation in some European countries and in the Czech Republic. The dissertation defines the basic term as – family, marriage differentiating them from the cohabitation of unmarried couples and especially from the registered partnership as a new phenomenon of the modern times. The cohabitation of a woman and a man outside the marriage is reflected in certain legal consequences in many legal regulations in both private and public law. The dissertation includes a certain review of the present legislation and an evaluation of the different types of legal regulation. It defines the different models of alternative forms of cohabitation existing abroad stressing the fact that such legal regulations do not concern only persons of same sex, but also persons of different sex. Human relations and especially the relations between the partners are nowadays among the topics being under a large discussion in the society. The people speak frequently of the increasing number of parents raising their children within relationships outside the marriage, as well as of the crisis of traditional family forms. The alternative forms of cohabitation are undoubtedly nowadays a very topical subject from the social point of view and therefore when the legislation on registered partnership of persons of same sex was being passed, considerable discussions arose. The question remains opened whether the Czech Republic will join the countries where the marriage can be contracted also by persons of the same sex (for instance Belgium, Spain, Netherlands), and whether, and if the case may be, when the institute of marriage and the institute of registered partnership will be equalized in the Czech legal system? The dissertation may serve as an impetus to consider de lege ferenda any new possibilities and solutions that might become an inspiration for the legislators at the time of discussions on possible modifications, if any, of the Czech legal system in the field of cohabitation of partners. For many centuries the family has been considered as a stabilizing element of the society as something constant and even sacred. At the same time, it has been looked at by the people as the only traditional and acceptable form of cohabitation of a man and a woman. Nowadays, it is facing great challenges. This dissertation can be also summarized as an attempt to find a new and totally unbiased vision of the different alternative forms of human cohabitation.
