Abstract:

Cílem této diplomové práce je přinést přehledné základní vymezení tuzemské právní úpravy v oblasti poskytování spotřebitelských úvěrů a ochrany spotřebitele s přihlédnutím k přiblížení postupů finančních institucí při jejich poskytování. Tato práce je pomyslně rozdělena na dvě části; V prvé části jde zejména o definování a vymezení základních pojmů a institutů této problematiky jakými jsou: rozdíly úvěru a spotřebitelského úvěru, spotřebitel a poskytovatel spotřebitelského úvěru, typy spotřebitelských úvěrů či zákonné náležitosti poskytovatele spotřebitelských úvěrů. V druhé části se práce věnuje zejména praktickým příkladům z praxe, které mají čtenáři představit tuto problematiku z pohledu finančních institucí a jejich postupů při ochraně spotřebitele. Tato část práce je dále proložena judikáty, které posuzované otázky a zmíněné příklady doplňují. Výsledkem je pak nejen přehled právní úpravy v této oblasti, ale též i praktické přiblížení přístupů finančních institucí při poskytování spotřebitelských úvěrů s přihlédnutím ke stávající právní judikatuře v této oblasti.

Abstract:

The aim of this diploma thesis is to bring a clear basic definition of domestic legislation in the field of consumer credit and consumer protection, taking into account the approach to the procedures of financial institutions in their provision. This work is imaginarily divided into two parts; The first part is mainly about defining and defining the basic concepts and institutes of this issue, such as: differences between credit and consumer credit, consumer and consumer credit provider, types of consumer credit or legal requirements of the consumer credit provider. In the second part, the work deals mainly with practical examples from practice, which are to introduce readers to this issue from the perspective of financial institutions and their procedures in consumer protection. This part of the work is further interspersed with case law, which complements the issues assessed and the examples mentioned. The result is not only an overview of legislation in this area, but also a practical approach to the approaches of financial institutions in the provision of consumer credit, taking into account the existing legal case law in this area.
