Wite ablation of liberties, principles of its assessment and presecution

Abstract:

In the first part of first capture, we addict to approximation of penalty depriving of freedom during the history of Czechoslovakia as well as separate of Slovakia and from 1918 after First World War, when there was legal dualism existed. In the second part of first capture, we described the penalty depriving of freedom from 1961 where was created Criminal Law and according to the sources of criminal law in other socialist countries. In the second capture, we deal with the adjustment of imprisonment, the imposition andenforcement of currently applicable under the Criminal Code. In a separate section of the second capture, we addcit to withheld sentence. In the second capture in a separate section, we described an impunity as well, which is adjusted in Criminal Code. In the third capture, we compared the penalty depriving of freedom modified in the Czech Criminal Law with imprisonment dressed in Slovak Criminal Law. We found similar and different characters of imprisonment. Finally, we summarize our view of penalty depriving of freedom.

Abstract:

V prvej časti prvej kapitoly sa venujeme priblíženiu trestu odňatia slobody počas histórie Československa ako aj samostatného Slovenska a to od roku 1918 po prvej svetovej vojne, kedy existoval na našom území právny dualizmus. V druhej časti prvej kapitoly sme popísali trest odňatia slobody od roku 1961 kedy bol vytvorený trestný zákon, na základe a podľa prameňov trestného práva iných socialistických krajín. V druhej kapitole sa zaoberáme úpravou trestu odňatia slobody, jeho ukladaniu ako aj výkonu v súčasnosti podľa platného trestného zákona. V samostatnej časti druhej kapitoly sa venujeme upusteniu od potrestania. V druhej kapitole sme ešte v samostatnej časti popísali beztrestnosť, ktorá je tiež v trestnom práve upravená. V tretej kapitole sme komparovali trest odňatia slobody upravený v českom trestnom zákonníku s trestom odňatia slobody upravenom v slovenskom trestnom zákonníku. Našli sme podobné ako aj rozdielne znaky trestu odňatia slobody. Na záver sme zhrnuli náš názor na trest odňatia slobody, zásady jeho ukladania a výkonu.
