Parallel trade of pharmaceuticals in the Czech Republic

Abstract:

Rigorózní práce se zabývá problematikou souběžného obchodu s léčivy v EU se zaměřením na ČR. Teoretická část práce popisuje zdravotní a lékovou politiku, jejich aktéry a poukazuje na specifitu farmaceutického trhu. Dále je rozebírána dynamika zdravotnického a farmaceu- tického trhu, kde je kladen důraz na analýzu nákladů na léčiva a jejich možné snižování a re- gulace. Dále se práce zabývá distribucí léčiv a typy distribučních řetězců, paděláním léčiv a protipadělkovou směrnicí. Hlavním tématem práce je SO, u kterého je popsána legislativa, jeho přínosy a rizika, srovnání jednotlivých států v rámci EU/EHP a opatření a návrhy řešení rizik, které s sebou může SO přinášet. Praktická část obsahuje dotazníkové šetření, které zkoumá postoje různých aktérů lékové po- litiky vůči SO. Dotazník zjišťuje, jak tito aktéři vnímají jeho legislativní ukotvení, jeho regulaci, jeho přínosy a rizika a jaké by navrhli změny na zlepšení tohoto procesu do budoucna tak, aby české zdravotnictví a pacienti nebyli SO negativně ovlivněni.

Abstract:

The rigorous thesis deals with the issue of parallel trade in pharmaceuticals in the EU with a focus on the Czech Republic. The theoretical part of the thesis describes the health and drug policy, its actors and points out the specifics of the pharmaceutical market. Furthermore, the dynamics of the healthcare and pharmaceutical market are discussed, with emphasis on the analysis of the costs of pharmaceuticals and their possible reduction and regulation. Furthermore, the thesis deals with the distribution of pharmaceuticals and types of distri- bution chains, the counterfeiting of pharmaceuticals and the anti-counterfeiting directive. The main topic of the thesis is the parallel trade of pharmaceuticals in the Czech Republic, where the legislation, its benefits and risks, comparison of individual countries within the EU/EEA and measures and proposals for addressing the risks that parallel trade of phar- maceuticals may entail are described. The practical part includes a questionnaire survey which examines the attitudes of different drug policy actors towards the parallel trade. The questionnaire finds out how these actors perceive its legislation, its regulation, its benefits and risks, and what changes they would suggest to improve this process in the future so that the Czech healthcare system and patients are not negatively affected by the parallel trade.
