The Role of Regional Governments in the Process of National EU Policy Formulation and its Articulation in the Council of the EU

Abstract:

Evropská integrace má pro své účastníky dalekosáhlé důsledky. Mimo jiné proto, že předpokládá přenos určitých původně státních pravomocí do působnosti nadnárodních orgánů. V případě osmi evropských států proniká supranacionalizace ještě hlouběji, neboť postihuje rovněž kompetence samosprávných regionů. Regionální vlády, na rozdíl od vlád národních, přitom nejsou automaticky kompenzovány možností účasti na práci klíčového unijního normotvůrce. Schopnost regionálních vlád vstupovat do rozhodovacího procesu na půdě Rady EU a jejích instancí je závislá na mechanismech ošetřených domácí právní úpravou. Právě tyto tzv. korektivní mechanismy a role, kterou díky nim regionální vlády v rámci formulace a artikulace národní evropské politiky hrají, jsou v zorném poli předkládané práce. Ta si pokládá hned několik výzkumných otázek. A sice: Jaké korektivní mechanismy jsou v dotčených státech zavedeny? Jak zavedené korektivní mechanismy prakticky fungují? Jakou roli při tvorbě a obhajobě národních pozic vlády legislativních regionů díky zavedeným korektivním mechanismům hrají? Jsou možnosti vlád legislativních regionů plynoucí z ustavených korektivních mechanismů srovnatelné? Resp.: Jak se liší role (postavení) vlád legislativních regionů v procesu formulace a artikulace národních pozic? A konečně: Čím je dána skutečnost, že se role (postavení) vlád legislativních regionů v procesu formulace a artikulace národních pozic liší nebo naopak neliší? A v návaznosti na to: Jakým způsobem ovlivňují institucionální rysy politicko-teritoriálního uspořádání zkoumaných států roli (postavení) vlád legislativních regionů v procesu formulace a artikulace národní unijní politiky?

Abstract:

The European integration process has far-reaching consequences for its participants. Among other things, it envisages the transfer of competences from the member states to the supra-national bodies. In the case of eight EU members, the supra-nationalization has an even deeper impact, since it also affects regional autonomy. The regional governments, unlike the national governments, are not automatically compensated for the loss of their powers with participation in the work of the foremost EU law-maker. The regional governments’ ability to partake in EU decision-making through the Council of the EU depends on specific channels defined by domestic legal and political systems. Just these so-called corrective mechanisms and the role that the regional governments play because of them are the main concern of this Ph.D. thesis. The research questions are defined as follows: What corrective mechanisms are introduced in the said countries? How do the corrective mechanisms really work? What is the role that the regional governments play due to these mechanisms in terms of national EU policy formulation and articulation? Are the regional governments’ abilities comparable? And finally: What determines the differences or the similarities in the role (and power) of the regional governments in the process of national EU policy formulation and articulation? How do political institutions of the federal political systems influence the role that the regional governments play in the process of national EU policy formulation and articulation?
