Capital Punishment and Human Rights in the South of the United States of America: Florida vs. South Carolina

Abstract:

This bachelor thesis explores the development of capital punishment and how it was influenced by the evolving system of social repression of African Americans from the end of the Civil War until the 21st century, especially in the South of the USA. It introduces the historical development of the death penalty in the context of the Black rights abuse and racial violence from the Reconstruction era, Jim Crow laws, through the 1960s and 1970s, and the imposed death penalty moratorium in 1972, until the 21st century. The main focus of the thesis is a comparative analysis of two Southern states' criminal justice systems and their exoneration data to prove a lingering racial bias in their death penalty cases. Florida and South Carolina have respectively the national highest and lowest numbers of wrongfully convicted prisoners, in spite of sharing similarly violent histories and geographical location. The research outcomes suggest that the higher exoneration rates in Florida might be explained by the abundance of legislative changes in the death penalty statute after 1972, and also might be caused by the undeveloped review and appellate system of capital cases. The thesis also finds a strong disparity among races of death penalty case victims, suggesting that race still plays a role in modern capital cases.

Bakalářská práce se zabývá vývojem trestu smrti a tím, jak jej ovlivnil vyvíjející se systém sociální represe Afroameričanů zejména na jihu USA od konce občanské války až do 21. století. Nastiňuje historický vývoj trestu smrti v kontextu potlačování práv Afroameričanů od období Rekonstrukce, zákonů Jima Crowa přes revoluční 60. a 70. léta 20. století a zavedené celonárodní moratorium trestu smrti v roce 1972, až po 21. století. Hlavním cílem práce je komparativní analýza justičního systému a systému trestního práva dvou jižanských států a následná analýza dat vězňů, kteří v nich byli neprávem odsouzeni k smrti. Tento výzkum má poukázat na přetrvávající rasovou zaujatost v případech trestu smrti. Florida a Jižní Karolína mají (v tomto pořadí) celonárodně nejvyšší a jeden z nejnižších počtů neprávem odsouzených vězňů, a to i přes svou podobně násilnou historii a geografickou blízkost. Výsledky naznačují, že vyšší počet osvobozených vězňů na Floridě nejspíš lze vysvětlit množstvím legislativních změn mechanismu trestu smrti po roce 1972, a také nedostatečně rozvinutým systémem pro odvolání a zpětné přezkoumání jednotlivých případů. Práce také zjistila výrazný statistický rozdíl mezi barvou pleti obětí případů trestu smrti, což naznačuje přetrvávající rasový vliv i v moderní éře trestu smrti.
