A Right to a Fair Trial

Abstract:

Cílem této práce je vyzdvihnout nezbytné složky pojetí práva na spravedlivý proces. A porovnat, jak tyto složky jsou ve skutečnosti naplňovány v členských zemích EU a jednotlivých zemích, jenž projevují úsilí v budoucnu do EU vstoupit. Tato práce shrnuje, jak je spravedlivý proces zakotven v psaných zákonech v jednotlivých státech. Jako výsledek pozorování by měno být patrné, zda v zemích dochází k jasným změnám a zlepšení úrovně dodržování práv a svobod na příkladě práva na spravedlivý proces a jeho jednotlivých atributech, jsou-li psané zákony zajišťující spravedlivé řízení v porovnávaných zemích převážně shodné a zda-li dle tohoto logického postupu se jejich šance na vstup do EU zvyšuje.

Abstract:

The aim of this work is to underline the most necessary attributes of the understanding of a right to the fair trial. And to compare how these attributes are fulfilled in reality in states of EU as well as in the non-EU countries, which has shown the attempts to join the union. Moreover, this work shows how the right to a fair trial is enshrined in the written law in different states. As a result of such studies it should be visible whether any changes and efforts are made to improve the current quality of fulfilling the law on the example of a right to the fair trial and its attributes. As well as it should be clear if the written law is mainly coincident with the law of other compared countries. And thus, whether those countries will have higher chances to join the EU.
