Abstract:

Resumé,Tato práce si klade za cíl analyzovat soudobé trendy mezinárodního práva na poli obrany proti terorismu. Za hlavní přístupy k boji proti terorismu jsou v této práci považovány přístup právní a přístup válečný. Hlavní zkoumanou tezí je tvrzení, že mezinárodněprávní úprava boje proti terorismu je ve své současné nedostatečně efektivní v zabraňování teroristickým činům a zároveň tento systém není schopen zabránit transgresím platného mezinárodněprávního rámce ze strany států, které si v boji proti terorismu zvolily cestu svémoci. V první části práce je tak rozebírán právní přístup, za jehož hlavní projev autor považuje rámet třinácti globálních protiteroristických instrumentů vytvořených na půdě OSN. Bližší pozornost je pak věnována otázce jurisdikce nad teroristickými činy, institutu extradice a nástroji omezení nakládání s majetkem. Z hlavních vlastností právního přístupu je vyzdvihován zejména respekt k základním právům a nedostačující opatření v oblasti prevence terorismu na globální úrovni. Poukazováno je také na absenci univerzální definice terorismu. Ve druhé části této práce je rozebírán válečný přístup k boji proti terorismu, což je směr relativně mladý, v převážné míře konstituovaný až po útocích z 11.září 2001. Poukazováno je zejména na fakt, že přístup válečný nestojí proti přístupu právnímu v přímé opozici, dokonce z něj i v mnoha aspektech vychází. Zdůrazněno je zejména zaměření tohoto přístupu na prostředky preventivní, z nichž blíže je rozebíráno monitorování komunikace, existence utajených detenčních center a otázka preemptivní sebeobrany. Na válečném přístupu je připomínána neprůkaznost jakýchkoli výsledků vzhledem k faktu, že celá řada klíčových informací je utajovaná. Kritizovány jsou však transgrese platného mezinárodního práva, zejména porušování základních práv. Ve třetí kapitole je pojednáváno o současné formě boje proti terorismu na území EU. Blíže je zkoumán instrument evropského zatýkacího rozkazu a implementace globálního sankčního režimu. Kritika EU se pak týká převážně nedostatečné spolupráce zpravodajských a policejních služeb členských států EU s evropskými orgány a úřady, např. EUROPOL. Evropská unie však je dávána za příklad organizace, která má díky své bezprecedentní míře integrace značný potenciál v oblasti boje proti terorismu. Závěr je shrnutím celé práce, ve kterém je zdůrazněn zejména problém definice terorismu, otázka prevence a ochrana základních práv. V celkovém pohledu se základní teze ukazuje být podloženou, je však upozorněno na fakt, že dodržování standardu základních práv je problémem nejen válečného, nýbrž překvapivě i právního přístupu.

Abstract:This thesis aims at analysing contemporary trends in the international law in the field of defense against terrorism. In the beginning of the thesis, legal and war approaches are identified as the two most important of contemporary ways of defense against terrorism. The main hypothesis is the statement: Current international legal framework is not sufficiently effective in preventing acts of terror while it is also unable to prevent transgressions of international law by states that chose arbitrary actions to defend themselves against this threat. The first part of this thesis is devoted to exploration of the legal approach. The author considers the thirteen global counterterrorism instruments drafted by the UN to be the backbone of the contemporary international legal framework in the field of combatting terrorism. More attention is devoted to the question of jurisdiction over terrorist offences, the institute of extradition and the current asset freezing regime. Of all the attributes of the legal approach, respect for basic rights is pinpointed, while insufficient coordination in the effort of preventing terrorism and the absence of universal definition of terrorism is criticized. The second part of this thesis describes the war approach to combatting terrorism which is a relatively young approach, mostly constituted after the attacs of 9/11. The author maintains that this approach doesn't directly oppose the legal approach, it even shares some of its instruments instruments. The focus on prevention while specifically examining monitoring of communication, the existence of secret detention centres and the concept of preemptive strikes. The thesis reminds that most of the conclusions are inconclusive due to excessive amount of necessary data being classified. The critiscism, however, lies in the fact that the war approach sometimes transgresses the norms of international law, specifically basic rights framework. The third chapter consists of the analysis of the contemporary form of fighting the terrorism on the EU territory. Closer attention is devoted to the instrument of european arrest warrant and the implementation of the global sanction regime. The criticism of EU's approach lies mainly in the insufficient cooperation of intelligence and law enforcement agencies of the EU member states with central departements and organs, such as the EUROPOL. The EU, however, is given as an example of an organization that due to its unprecedented level of integration, holds within itself a great potential on the field of defence againt terrorism. The conclusion sums up the thesis and consequently reiterates on the problem of the definition of terrorism, question of prevention and the protection of basic rights. Overall, the main hypothesis shows itself to be proven, albeit it is stressed that the thesis shows that both war and suprisingly legal approach have issues with the maintenance of the basic rights framework.
