Custodial Institutes in Civil Relations and its Advantages and Disadvantages

Abstract:

Bakalářská práce se zaměřuje na problematiku zajištění dluhu v českém právním řádu a převážně vychází z ustanovení nového občasného zákoníku, ale zohledňuje také předchozí právní úpravu a související judikaturu. První část práce popisuje různé aspekty jednotlivých zajišťovacích institutů včetně jejich výhod a nevýhod, rovněž pojednává o institutech utvrzení dluhu, které jsou dle stávající právní úpravy od zajišťovacích institutů důsledněji odlišeny. Řadíme mezi ně zejména smluvní pokutu a uznání dluhu. Práce se také věnuje komparaci stávající a předešlé právní úpravy a změnám, které přinesla rekodifikace soukromého práva.

Abstract:

Bachelor thesis focuses on the issues regarding the securing of debt in the Czech legal system and mostly it draws information from the new civil code, but it also takes into account previous legislation and relevant practice of the courts. The first part of the thesis describes different aspects of individual custodial institutes including their advantages and disadvantages, it also addresses the affirmation institutes, which are more thoroughly differentiated in the current legislation. We can count among them specifically a contractual fine and an acknowledgement of debt. Thesis also contains a comparison of the current and previous legislation and focuses on the changes, brought on by the recodification of the civil law.
