Status of an Obliged Person's Spouse in the Tax Execution

Abstract:

Diplomová práce se zabývá postavením manžela ve vymáhacím procesu vedeném Finanční správou České republiky. Po krátkém vymezení nedoplatků, společného jmění manželů a vztahů mezi nimi, je pozornost věnována podmínkám a možnostem postihu majetku manžela dlužníka a majetku patřícího do společného jmění manželů. Těžiště práce spočívá v analýze jednotlivých způsobů provedení daňové exekuce, kterými je tento majetek exekvován, s poukázáním na postupný vývoj právních norem v dané oblasti, k jejichž výkladu často přispívá judikatura. Poslední kapitola práce se zaobírá prostředky obrany manžela dlužníka při postihu jeho majetku.

Abstract:

This master’s thesis deals with the status of an obliged person’s spouse in an enforcement process led by Financial Administration of the Czech Republic. After a brief explanation of arrears, joint property of spouses and relations between them, the attention is paid to conditions and possibilities of executing the property of the obliged person’s spouse and of the property that belong to the joint property of the spouses. The focus of the thesis lies in analysis of individual methods of the tax execution by which this property is executed, with pointing out to the gradual development of legal regulation in examined area, when jurisprudence often contributes to the interpretation of them. The last chapter focuses on the means of defence of the obliged person’s spouse when his property is being executed.
