Abstract:

Author: Holubová Ivana, Title: Breach of conditions of contract and the consequences, delay of creditor, delay of debtor in commercial and civil law (Bachelor thesis). Bank Institute High School Prague, High School Foreigh Banská Bystrica, Department of law and social science. Tutor: Mgr. Barbara Michalková, Year of habilitation: 2012, extent of thesis: 61. The Bachelor thesis deals with the breach of conditions of contract and the consequences, delay of creditor, delay of debtor in commercial and civil law, and it is structured into four chapters and subsections. The first chapter is provides definition and concept of contractual relations, creation of contractual relation and its subjects. The second part analyses the differences between the terms delay of creditor, delay of debtor, the fulfillment of commitments and consequences and punishment for breach for delay. The third chapter concentrates on ways to ensure commitment according to juridical institutes for creation of law, the contractual penalty and compensatory damages. The final part reveals the difference between contractual ralations according to Business code and Civil code, and comparison of legal regulations of chosen instututes of commitment ensuring.

HOLUBOVÁ, Ivana: Porušenie zmluvných povinností a jeho následky, omeškanie dlžníka, omeškanie veriteľa v obchodnom práve a občianskom práve. (Bakalárska práca). Bankovní institut vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. Katedra práva a spoločenských vied. Vedúci práce: Mgr. Barbara Michalková. Rok obhajoby: 2012. Počet strán: 61. Bakalárska práca sa zaoberá porušením zmluvných povinností a jeho následkami, omeškaním dlžníka a omeškaním veriteľa podľa obchodného a občianskeho práva. Pozostáva zo štyroch kapitol a niekoľkých podkapitol. Prvá kapitola je zameraná na vymedzenie a charakteristiku záväzkových vzťahov, vznik záväzkových vzťahov a subjekty záväzkového vzťahu, Druhá kapitola analyzuje rozdiely v omeškaní dlžníka a omeškaní veriteľa a plnenie záväzkov a následky a postihy v prípade omeškania. Tretia kapitola pojednáva o zabezpečení záväzkov podľa vybraných inštitútoch vzniku záväzku, a to pri zmluvnej pokute a náhrade škody. Vo štvrtej kapitole je rozanalyzovaný rozdiel záväzkových vzťahov v Obchodnom zákonníku a v Občianskom zákonníku, porovnanie právnej úpravy vybraných zabezpečovacích inštitútov.
