Amendment of the Building Code in regard to increase of effectiveness of state legislation

Abstract:

Tématem této práce je novelizace stavebního zákona provedená zákonem č. 225/2017 Sb., která nabyla účinnosti 1. ledna 2018. Záměrem novely bylo urychlit a zjednodušit průběh projednávání staveb. Zavedením nového závazného stanoviska orgánu územního plánování se však tato situace ještě více zkomplikovala. Práce se také zabývá rolí veřejné správy v povolovacím procesu, odpovědností státu za výkon veřejné moci včetně kompetence stavebních úřadů a popisuje legislativní proces schvalování novely stavebního zákona. Stavební předpisy se v jednotlivých zemích odlišují, základní předpoklad je však stejný. Stavebník je povinen před zahájením stavby získat stavební povolení. Nejen v České republice je dlouhodobým cílem zjednodušení administrativní zátěže a urychlení povolovacího procesu. Avšak dle žebříčku Světové banky, která sleduje nařízení mající dopad na malé a střední podniky, se to v jiných státech daří mnohem lépe než u nás.

Abstract:

The topic of this work is an amendment to the Building Act implemented by Act No. 225/2017 Coll., which came into effect on 1 January 2018. The aim of the amendment was to accelerate and to simplify the course of construction. By introducing a new binding opinion from the Spatial Planning Authority however, this situation has become even more complicated. The thesis also deals with the role of public administration in the permitting process, the state's responsibility for the exercise of public authority, including the competence of building authorities, and describes the legislative process of approving the amendment to the Building Act. Building regulations differ from country to country, but the basic assumption is the same. The builder is obliged to obtain a building permit prior to construction. Not only in the Czech Republic is the long-term goal of simplifying the administrative burden and speeding up the authorization process. However, according to the World Bank's ranking, which has regulations affecting small and medium enterprises, it is doing much better in other countries than it is in our country.
