Comparison of FIDIC Contractual Regime and the Czech Legal Regulation of Building Contracts
Abstract:
Diplomová práce rozebírá obchodní podmínky ve stavebnictví vytvořené na základě smluvních vzorů FIDIC ve vztahu k úpravě v českém občanském zákoníku a v zákoně o veřejných zakázkách. Práce se zaměřuje na úpravu změnových procesů (především změny ceny díla a lhůty pro dokončení) a na alokaci rizik ve výstavbovém projektu mezi objednatele a zhotovitele v tzv. červené knize FIDIC (CONS).
Abstract:
This thesis analyzes the Conditions of Contract for Construction created under the FIDIC forms of contract in relation to the legislation in the Czech Civil Code and the Public Procurement Act.
