Negative Prescription and its Regulation in the New Czech Penal Code

Abstract:

Promlčení v trestním právu představuje širokou společností vysoce diskutované téma. V souvislosti se vstupem nového zákona č. 40/2009 Sb., trestního zákoníku, v účinnost došlo k několika změnám souvisejícím s promlčením trestní odpovědnosti i výkonu trestu. Cílem této diplomové práce je co nejkomplexněji rozebrat úpravu promlčení v novém českém trestním zákoníku v souladu s trestněprávní teorií, porovnat ji s úpravou předcházející a s úpravami vybraných evropských států a Spojených států amerických. Důraz je přitom kladen na zdroje judikatorního charakteru, které se dané problematiky dotýkají a doplňují tak zákonnou úpravu. Závěrem se práce zabývá zhodnocením stávající úpravy a možnými návrhy de lege ferenda.

Abstract:

Negative prescription (hereinafter also as „limitation“) in criminal law represents highly discussed topic in the wide society. Some changes to the limitation of the criminal liability and to the limitation of the punishment coercion were made in the relation to the new statute number 40/2009 Sb., the Penal code, coming into force. The main goal of this thesis is to make a most complex explanation of the term negative prescription in the new czech Penal Code with regard to the criminal law theory. This thesis also compares this institute with statutes of some selected European countries and United States of America. The emphasis is placed on the sources of judicial character which are connected to this topic and which complete the legal framework. In the end, this thesis is focused on the evaluation of the current statutory regulation of negative prescription and possible suggestions de lege ferenda.
