Legal Aspects of Participation in Construction Proceedings and in Planning

Abstract:

Tato diplomová práce je pojata jako právní charakteristika či rozbor mnoha aspektů účastenství ve stavebním a územním řízení. Autor podává ucelený přehled o problematice účastenství podle aktuálně účinného znění stavebního zákona a rovněž v obecném pohledu podle správního řádu. Z obsahu práce je patrná cílená orientace autora zejména na ty právní aspekty účastenství ve stavebním a územním řízení, které mnohdy bývají předmětem diskusí. Rozpracována je tedy například problematika přímého dotčení práv účastníků řízení, obsahově je vymezen pojem sousední pozemek a rozpracována je také otázka účastenství občanských sdružení ve stavebním řízení. Autor průběžně formuluje své postřehy a závěry, včetně námětů de lege ferenda. Práce je rozdělena do devíti kapitol. V úvodu je zpracována organizace, příslušnost a působnost obecných a zvláštních stavebních úřadů, jsou charakterizovány dotčené orgány a problematika vydávání závazných stanovisek. V dalším obsahu je práce zaměřena na subsidiární použitelnost správního řádu v řízení dle stavebního zákona při umisťování a povolování staveb. V rámci kapitoly o obecném vymezení účastenství ve správním řízení jsou charakterizovány jednotlivé skupiny účastníků řízení podle správního řádu, dále postup v případě pochybností o postavení účastníka a procesní způsobilost účastníků řízení. Stěžejní část této práce představují kapitoly o účastenství v územním a stavebním řízení. V úvodu těchto kapitol je charakterizováno územní rozhodnutí a stavební povolení, ale také zjednodušující instituty, které mohou klasické územní či stavební řízení plně suplovat. Problematika územního rozhodování tak obsahuje, kromě klasického územního řízení, rovněž institut zjednodušeného územního řízení, dále územní souhlas a institut veřejnoprávní smlouvy, která může nahradit některé druhy územních rozhodnutí. Podkapitola o povolování staveb popisuje stavební řízení, zkrácené stavební řízení, institut veřejnoprávní smlouvy, která může nahradit povolení stavby nebo terénních úprav, a ve stručnosti rovněž režim ohlašování staveb. Dále jsou podrobně vymezeny jednotlivé subjekty, kterým stavební zákon přiznává postavení účastníka v územním či stavebním řízení. Ve snaze o maximální přehlednost práce jsou jednotliví účastníci územního a stavebního řízení charakterizováni na podkladě jejich dělení podle aktuální dikce ustanovení § 85 a § 109 stavebního zákona. Práce neopomíjí ani negativní vymezení účastníků územního a stavebního řízení. V kapitolách o účastenství v územním a stavebním řízení je vždy obsažena rovněž problematika námitek uplatňovaných účastníky toho kterého řízení a způsobu doručování v řízení. Pouze pro úplnost a možnost porovnání jsou stručně vymezeny rovněž okruhy účastníků v dalších řízeních podle stavebního zákona. V souvislosti se schvalovanou novelou stavebního zákona jsou ve stručnosti v práci zmíněny navrhované změny, které souvisejí s tématem práce. Jde zejména o změny týkající se okruhu účastníků stavebního řízení. Závěr práce je obohacen o některé náměty de lege ferenda, když autor například považuje za vhodné změnit způsob doručování písemností v územním řízení účastníkům podle ustanovení § 85 odst. 2 stavebního zákona. Za stávajícího stavu, pokud je v území schválen územní či regulační plán, jsou veškeré písemnosti v územním řízení těmto účastníkům doručovány veřejnou vyhláškou. enství v územním a stavebním řízení by autor považoval také posílení ochrany práv nájemců bytů, nebytových prostor a pozemků. Ochrana užívacích práv v územním a stavebním řízení je ponechána na vlastníkovi nemovitosti, který by měl v řízení „reprezentovat“ oprávněné zájmy nájemce. Práva nájemců ale mohou být v některých případech velmi oslabena, například pokud pronajímatel sám pro sebe žádá o vydání územního rozhodnutí či stavebního povolení.

Abstract:

This diploma thesis is drawn up as a legal characterization or analysis of a number of aspects of participation in construction and planning proceedings. The author gives a comprehensive overview of the issue of participation in accordance with the currently effective wording of the Building Act and generally under the Administrative Procedure Code. The thesis contents show the author’s purposeful focus particularly on those legal aspects of participation in construction and planning proceedings that often become a subject of discussions. Therefore, the author addresses e.g. the issue of direct affection of rights of participants in proceedings, defines the term “adjacent plot of land” and also deals with the issue of participation of civic associations in construction proceedings. The author continuously formulates his observations and conclusions, including de lege ferenda suggestions. The thesis is divided into nine chapters. The introductory part addresses the organisation, competences and powers of general and special building authorities, characterizes affected bodies and the matter of issue of binding standpoints. The thesis also examines the subsidiary applicability of the Administration Procedure Code in proceedings under the Building Act in respect of location and permitting of constructions. The chapter that generally defines participation in administrative proceedings contains characteristics of individual groups of participants in proceedings under the Administrative Procedure Code, the procedure to be taken in the event of doubts about the position of a participant and the procedural capacity of participants in the proceedings. The main part of the thesis consists of chapters about participation in planning and construction proceedings. The introductory part of these chapters characterizes not only planning and construction proceedings but also certain simplifying institutes that may fully substitute a conventional planning decision or building permit. In addition to conventional planning proceedings, the issue of planning decision-making includes the institute of simplified planning proceedings, planning approval and the institute of a public-law contract that may replace some kinds of planning decisions. The subchapter focused on permitting of constructions describes construction proceedings, simplified construction proceedings and the institute of a public-law contract that may replace a construction or landscaping permit, and provides a brief description of the procedure of construction notification. It also specifies in detail individual subjects that hold a position of a participant in planning or construction proceedings under the Building Act. In the effort for maximum clarity of the thesis, individual participants of planning and construction proceedings are characterised on the basis of their classification according to the current wording of the provisions of Sections 85 and 109 of the Building Act. The thesis does not miss out even negative specification of participants in planning and construction proceedings. The chapters on participation in planning and construction proceedings always include the issue of objections raised by participants in particular proceedings and the manner of delivery service in proceedings. Just for the sake of completeness and possible comparison, it also briefly specifies circles of participants in other proceedings under the Building Act. In connection with the amendment to the Building Act that has been read at present, the thesis briefly mentions proposed changes that relate to the topic of the thesis. Such changes are, in particular, changes relating to the circle of participants in construction proceedings. The final part of the thesis includes some de lege ferenda suggestions; e.g. the author considers appropriate to change the manner of delivering documents to the participants in planning proceedings under the provision of Section 85 Subsection 2 of the Buildi

Abstract:

The current practice is that when a municipal or regulation plan is approved in the area, all documents relating to the planning proceedings are delivered to the participants by means of a public notice. In the author’s opinion, it would be more appropriate to deliver the documents to individual participants. As a benefit for the current legal regulation of participation in planning and construction proceedings, the author would also regard strengthening of the protection of rights of tenants of flats, non-residential premises and plots of lands. The protection of the rights of use in planning and construction proceedings is left to the owner of a real estate that should “represent” justified interests of the tenants. In some cases, the rights of tenants may be very impaired, e.g. when the landlord themselves applies for the issue of a planning decision or building permit.
