End User License Agreement

Abstract:

Cílem této bakalářské práce je poskytnout zevrubný pohled na licenční smlouvu s koncovým uživatelem, s bližším zaměřením na některé její aspekty. V obecné části práce vysvětluje pojmy licence, respektive autorskoprávní licence a licenční smlouva v souvislosti se software, změny, ke kterým došlo v souvislosti s novým občanským záko-níkem a konečně EULA, a čím je tento typ smlouvy specifický. Dále se zaměřuje na několik konkrétních problémů souvisejících s EULA, a sice odpovědnost za škodu a vady, ochrana slabší strany a volba rozhodného práva. Ve zvláštní části se pak snaží tato práce aplikovat získané poznatky na konkrétní texty EULA. Práce se snaží danou pro-blematiku zpracovat jednoduše a bez zbytečných komplikací, rozhodně si neklade za cíl zpracovat rozsáhlou a kompilovanou problematiku EULA jako celku. Práce čerpá z momentálně dostupných zdrojů, a mimo situace, kde srovnává stávající úpravu s úpravou před 1. 1. 2014, zohledňuje právní stav k 1. 5. 2015.

Abstract:

The main goal of this bachelor thesis is to provide an insight on the workings of the End User Licence Agreement, with the focus on several of its aspects. The general part purpose is to explain the meaning of the terms licence, copyright and licence agreement in relation with software, the related changes that occurred with the new civil code and finally the EULA itself and how this type of contract differs from others. It continues focusing on several problems related to EULA, that is the liability for damages and for defects, the weaker contractual party protection and the choice of applicable law. In the special part, this thesis tries to apply the acquired knowledge on specific EULAs. The thesis tries to write up the given issue in a understandable way, that is free of unnecessary complications, it definitely does not aim to cover the complicated issue of EULA as a whole. The thesis is based only on currently available sources and excluding the parts, where it compares current legislation with the one valid before January 1st 2014, it takes into account the law effective as of May 1st 2015.
